This chapter shall be known as and may be cited as the "Royal
Oak Commission for the Arts Ordinance."
The importance of arts and culture to the City of Royal Oak
has been recognized by the City Commission through the adoption of
an objective to "develop a plan to encourage artists and promote public
art in Royal Oak" as part of a greater community goal to "preserve
neighborhoods by encouraging community involvement and family activities;
and further, to be recognized as a destination for entertainment,
recreation and cultural opportunities." This is a chapter to establish
the Royal Oak Commission for the Arts to encourage and support arts
and culture in the City of Royal Oak.
For the purpose of the provisions of this chapter, the following
words and phrases shall be construed to have the meanings herein set
forth, unless it is apparent from the context that a different meaning
is intended:
A term meant to represent all art disciplines and creative
artistic expressions, including, but not limited to, visual art, literary
art, or performing art. Examples include painting, drawing, sculpture,
photography, architecture, poetry, prose, theater, film, music, comedy,
and dance.
The diverse customs, values, attitudes, characteristics,
traditions, behaviors, and beliefs represented throughout humanity
which are often expressed through the arts.
Any works of art or creative artistic expression displayed
or presented on, in, or as a part of public spaces, public assets,
public property, or public rights-of-way.
In order to encourage and support arts and culture in the City
of Royal Oak, there is hereby created the Royal Oak Commission for
the Arts.
The Commission shall consist of seven voting members who have
experience or interest in the propagation, creation, design, performance,
instruction, or study of the arts. One of the seven voting members
shall be a member of the City Commission. The City Manager or his/her
designee shall serve as an ex officio nonvoting member of the Commission.
Commission members shall be appointed by the Mayor and confirmed
by the City Commission for terms of three years. The initial Commission
shall be staggered, with four members appointed for three years and
three members appointed for two years. Members of the Commission shall
be eligible for reappointment. Term limits, appointments, reappointments,
appointment terminations, and vacancy rules are subject to applicable
ordinance provisions. Vacancies shall be filled by appointment by
the Mayor and confirmation by the City Commission.
A.
It shall be the duty of the Commission to develop a long-term plan
and annual goals that serve to form and implement a strategy for encouraging
and supporting arts and culture in the City of Royal Oak. In December
of each year, all goals shall be submitted to the City Commission
for approval along with a report detailing the progress on previously
established goals.
B.
It shall be the duty of the Commission to propose arts policies,
programs, projects, initiatives, and events that fulfill established
goals to the City Commission for review and approval. The Commission
shall be responsible for managing or developing and implementing a
management plan for the execution of approved arts policies, programs,
projects, initiatives, and events.
C.
The Commission shall have the authority to raise funds for arts and
culture programs, projects, and events through the application of
grants, private sponsorships, donations, and other fund-raising strategies;
including the authority to interact with donors on behalf of the City
of Royal Oak. Funds raised and held by the Commission are public funds,
and shall be reserved for the purposes of this chapter.
D.
The Commission shall have the authority to create and bestow arts-focused
awards upon individuals and organizations on behalf of the City of
Royal Oak.
E.
The Commission shall promote the public awareness of arts and cultural
opportunities in Royal Oak including arts policies, programs, projects,
initiatives, and events.
F.
The Commission shall, with the assistance of the ex officio nonvoting
staff member, create and submit a policy for the City Commission's
approval that governs the review, selection, acceptance, donation,
liability, display, placement, de-accession and maintenance of temporary
and permanent public art on, in, or as a part of Royal Oak assets,
property, and rights-of-way. The Commission shall be responsible for
suggesting updates to the policy when deemed necessary.
G.
The Commission shall work with local organizations, nonprofits, and
businesses to encourage and support arts and cultural development
in Royal Oak, including the display of public art.
A.
The Commission shall elect a Chairman, Vice Chairman, Secretary,
and any other officers deemed necessary at the beginning of the first
meeting of each year. The Chairman shall preside over meetings and
will serve as a voting member of the Commission. The Vice Chairman
shall perform the duties of the Chairman in his/her absence. The Secretary
shall record the proceedings of the Commission.
B.
At least four members of the Commission shall constitute a quorum
for the approval of motions and transaction of its business. The Commission
shall adopt rules for the transaction of its business which shall
provide for the time and place of holding meetings.
C.
The concurring affirmative vote of four members shall constitute
approval of any formal action taken by the Commission, including,
but not limited to, the approval of goals, plans, or applications
before the Commission for review.
D.
The business that the Commission or subcommittees of the Commission
may perform shall be conducted in compliance with the State Open Meetings
Act.
E.
The Commission shall keep a record of its proceedings and actions.
A writing prepared, owned, used, in the possession of, or retained
by the Commission or subcommittees of the Commission in the performance
of an official function shall be made available to the public in compliance
with the State Freedom of Information Act.[1]
