Borough of Paulsboro, NJ Article II Defined Contribution Retirement Program

§ 60-1 Eligibility for program; exempt positions; implementation and construction.

A. Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:

(1) Elected officials;

(2) Administrator;

(3) Solicitor;

(4) Engineer;

(5) Prosecutor;

(6) Public Defender;

(7) Court Judge.

B. Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:

(1) Tax Collector;

(2) Chief Financial Officer;

(3) Construction Code Official;

(4) Tax Assessor;

(5) Registered Municipal Clerk;

(6) Licensed Uniform Subcode Inspector;

(7) Principal Public Works Manager;

(8) Court Administrator.

C. This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.

D. Should any part or parts of this article be held to be invalid by any competent court of law, such invalidity shall only affect the part or parts held to be invalid, and all other parts shall remain in effect.

E. A copy of this Ordinance No. 12.11 shall be filed with the Director of the Division of Pensions and Benefits of the New Jersey Department of the Treasury.
