The Village Board of the Village of Buchanan, being fully cognizant of the fact that considerable damage could be done to the property of residents of the Village of Buchanan and being also aware of the limited confines of areas within the Village of Buchanan and the close proximity thereto of residential and other structures and property inhabited and used by residents of the Village, and being further aware that the use of firearms in the Village is a matter affecting the public health, safety and welfare, which should be subject to control by the Village of Buchanan, intends by the enactment of this article to regulate the discharge of firearms within the Village of Buchanan.
No person shall, except in self-defense and when reasonably necessary for the protection of life or property, fire or discharge or cause to be fired or discharged any pistol, rifle, shotgun or any type of firearm within the boundaries of the Village of Buchanan.
A. 
The prohibitions contained in this article shall not apply to any officer of law while engaged in the protection of the safety of the people of the State of New York.
B. 
In all other instances, the Village Board may, upon written request, adopt a resolution granting permission for other shooting activities.
Any person committing an offense against any provision of this article shall be guilty of a violation punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
Nothing contained in § 199-4 of this article shall prevent the Village Board of the Village of Buchanan from maintaining an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or restrain by injunction the violation of any of the provisions of this article or any rule or regulation promulgated hereunder.
The definitions given herein deal only with certain terms used in this article, in the sense that they are used herein:
APPLICANT
Includes each and every individual who seeks to obtain a pistol permit.
APPLICATION FEE
The fee each individual shall pay to the Village of Buchanan for the services rendered by the Village of Buchanan to the applicant, exclusive of any and all other fees and costs required by law.
PISTOL PERMIT
The permit issued by the County of Westchester entitling an individual to legally own and possess a handgun.
Every individual who seeks to obtain a pistol permit application shall make a request for the same directly to the Chief of Police of the Village of Buchanan. As a condition precedent to obtaining the necessary application forms, each and every applicant shall comply with § 199-8 of this article.

Every individual who desires to obtain a pistol permit shall pay to the Village of Buchanan the Village application fee in an amount as set from time to time by resolution of the Board of Trustees. Said fee is to be paid in addition to any and all other fees and costs required by law to be paid by each applicant. No application shall be processed until the fee is paid in full.
