No person shall be entitled to engage in business as an auctioneer in Cecil County unless he shall have first taken out a license as hereinafter provided.

Each applicant for such a license shall pay the yearly sum of $25 if he is a resident of said County; the sum of $50 if he is a resident of the state outside of said County; and the sum of $100 if he is not a resident of the state, and no license shall be issued by said Clerk of the Circuit Court to any such person until the aforesaid license fee has been paid and until such person has made an oath as to his place of residence.

It shall be the duty of the Clerk of the Circuit Court of said County to issue auctioneer licenses to such persons as may apply for and be entitled to them under this chapter; and according to the conditions and provisions of this chapter, the amount so received from said licenses shall be paid to Cecil County, Maryland, to be credited to the general fund of said County.

The Clerk of the Circuit Court shall be entitled to the same fees and commissions for issuing the license, and paying into the treasury the money therefor, as for like licenses under the laws of this state.

No person shall be issued an auctioneer's license unless he has filed with the Clerk of the Circuit Court a bond in the amount of $5,000 for the use and benefit of any person, firm or corporation dealing with him as auctioneer and conditional on his proper accounting, payment and delivery of any monies or property entrusted to his care and possession while acting as an auctioneer. The bond shall be executed by a corporate surety licensed to do business in Maryland.

Every person conducting a sale in violation of § 148-1 of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be fined not less than $10 nor more than $50 in the discretion of the court.
