A. 
The owner/developer shall furnish a surety or cash bond, irrevocable letter of credit, or other means of security acceptable to the Department of Public Works. The bond amount should be equal to at least the cost of the installation, maintenance, and removal of the erosion and sediment controls shown on the approved plan.
B. 
The surety must be posted with the Department of Public Works prior to approval of the final erosion and sediment control plan.
C. 
The requirements of Subsection A above may be waived by the Department of Public Works under the following circumstances:
(1) 
Where duplication of bonding requirements would exist.
(2) 
For projects where the total estimated project cost is less than $5,000.
(3) 
For projects where the work is performed under the standard erosion and sediment control plan for activities with minor earth disturbances.
(4) 
For all state or County-funded projects.
