[HISTORY: Adopted by the Town Board of the Town of Poughkeepsie 10-5-2011 by L.L. No. 25-2011. Amendments noted where applicable.]
This chapter shall be known as the "Public Urination or Defecation Local Law of the Town of Poughkeepsie."
No person shall urinate or defecate:
A. 
In a public place, as defined in Penal Law § 240.00, whether indoors or outdoors, except in a designated public rest room or designated portable toilet;
B. 
Outdoors on private property, if visible from a public place; or
C. 
Outdoors on private property, if not visible from a public place, without the express permission of the owner.
Any person found guilty of violating this chapter shall be guilty of a violation and, upon conviction of a first offense, shall be subject to a fine of up to $1,000 or a term of imprisonment for a period of up to 15 days, or both; and upon conviction of a second offense, shall be subject to a fine of up to $1,500 or a term of imprisonment for a period of up to 15 days; and upon conviction of a third or subsequent offense shall be subject to a fine of $2,000 or a term of imprisonment for a period of up to 15 days, or both.
If any clause, sentence, paragraph, subdivision, section or any other part of this chapter shall for any reason be adjudged by any court of competent jurisdiction to be unconstitutional or otherwise invalid, such judgment shall not affect, impair or invalidate the remainder of this chapter, and it shall be construed to have been the legislative intent to enact this chapter without such unconstitutional or invalid parts therein.
