Pursuant to Section 16-12 (f) of the Utica City Charter and
for the reasons stated above,[1] the Common Council hereby determines that it is impracticable
to procure health insurance coverage for City Officers and Employees
by competitive bid.

Editor's Note: The whereas clauses of Ord. No. 17 stated
that numerous constraints imposed by the competitive bidding process
were not in the best interest of the City in that they did not allow
for competition nor did they allow the City flexibility in choosing
a plan.
The Board of Contract and Supply is hereby authorized and directed
to procure the insurance coverage described below from any provider
thereof who is licensed to do business in the State of New York, without
competitive bid.
(a)
Such health insurance coverage shall be for the officers and employees
of the City and their dependents who shall include:
(1)
All the officials and full-time employees of the City of Utica,
it being understood that permanent part-time employees who work at
least 20 hours per week shall be considered full-time employees, employees
entitled to health care benefits pursuant to union contract entered
into by the City of Utica, employees who are eligible by resolution
of the Board of Estimate and Apportionment and employees who are currently
participating in the City's health insurance program; and

(2)
Community Development employees, Urban Renewal employees and
other grant-in-aid programs shall be included as participants in the
City of Utica Health Insurance Program.
(b)
Excluded from the program are:
(1)
The President and members of the Common Council and their dependents.

(2)
All part-time employees who do not qualify as permanent part-time
employees and temporary employees, exclusive of Civil Service classification
and all permanent or part-time, seasonal employees and their dependents;
and
(3)
All officers, members and employees and dependents of the Utica
Transit Authority of the City of Utica, employees of other commissions
or independent or semi-independent agencies and authorities.
(c)
Other coverage available:

(1)
The President and members of the Common Council and their dependents
may, commencing January 1, 2012, opt to receive benefits from the
City plans, where applicable, to participate in those plans with a
contribution of 25% of the cost thereof.
(2)
The President and members of the Common Council may enroll only
for the single coverage plan. However, if said parties desire to enroll
in a more comprehensive plan, they may do so at their own additional
costs.
(3)
Stipend in lieu of the above health care insurance: $1,500.
The initial coverage shall be for a period from April 1, 1984,
through March 31, 1985, and at the City's option the contract
may be renegotiated at the end of each contract year for additional
one-year terms, and that the coverage shall be a fully paid hospital
plan for employees and dependents with a major medical rider, prescription
plan, and a dental and optical coverage as parts thereof, which plan
must be substantially equivalent to or better than medical insurance
coverage presently afforded to such officers and employees.
The entire cost of the above is to be made a charge against
the Budget of the City of Utica, General Account #A9060.8-Hospital
and Medical Insurance and accounts so established by other funding
programs and grant-in-aid-programs for the appropriate years.
This article shall not become effective unless unanimously approved
by the Board of Estimate and Apportionment.
