For application of the Rules and Regulations Governing Secondhand Dealers, terms shall be defined and used herein as follows:
Either:
A current driver's license that includes the photograph, date of birth, and address of the person offering the identification; or
Two other pieces of current identification, at least one of which is issued by a government agency or subdivision and includes the photograph, date of birth, and address of the person offering the identification.
A person who has a right of possession to an item of property superior to that of the seller.
An individual, partnership, corporation, limited liability company, joint venture, trust, association or any other legal entity, however organized.
A business that purchases secondhand regulated property.
A person engaged in the business of buying, selling, trading, or accepting for sale on consignment secondhand regulated property. The term "secondhand dealer" does not include a person whose only business transactions with secondhand regulated property in the Borough of Marcus Hook consist of a display space, booth, or table maintained for displaying or selling regulated property at any trade show, convention, festival, fair, circus, flea market, garage sale, yard sale, or swap meet event for less than 12 days in any calendar year.
Goods which have been previously owned, worn or used by another, not new.
The purchase of regulated property.
A book or collection of documents generated by point-of-sale software in which shall be recorded at the time of purchase an accurate account and description of the regulated property being purchased, including make, model, and serial number if applicable; the time of the transaction; and a copy of the seller's acceptable identification.
Previously owned or put into service by a person other than the manufacturer or the manufacturer's dealer or agency.
