Borough of Edgeworth, PA Traffic Regulations

The following maximum speed limits for all streets, roads, highways and alleys within the Borough and subject to its regulation under the Vehicle Code[1] are established:

(1)

On all streets, roads and alley within the Borough (other than State Route 65, Ohio River Boulevard, Little Sewickley Creek Road and Way Hollow Road), 25 miles per hour, except on those portions of such streets, roads and alleys where a lesser speed limit is applicable under the law.

In all properly designated school zones, 15 miles per hour.

No person shall drive a vehicle at a greater rate of speed than the applicable maximum. Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $35 and costs. Any person exceeding a maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit.

§ 123-8 No passing zone established.

No motor vehicle may pass another moving motor vehicle traveling in the same direction on Beaver Road, for its entire extent throughout the Borough. Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 123-9 Through highways established.

The following highways are established as through highways, and stop signs shall be erected at every intersection with any through highway, facing traffic approaching the through highway on all intersecting streets. Every driver of a vehicle approaching a through highway on any intersecting street shall stop the vehicle as required by § 3323(b) of the Vehicle Code and shall not proceed into or across the through highway until he/she has followed the requirements of that section of the laws:

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 123-10 Stop intersections established.

The following intersections are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street upon the first-named street in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection upon the first-named street, in the direction indicated in each case, shall stop the vehicle as required by § 3323(b) of the Vehicle Code and shall not proceed into or across the second-named street until he/she has followed the applicable requirements of the law:

§ 123-11 Certain streets restricted to passenger vehicles only.

All roads, highways, streets and alleys in the Borough of Edgeworth (other than State Route 65, Ohio River Boulevard, Little Sewickley Creek Road and Way Hollow Road) are set aside for the use of passenger vehicles only (including private passenger vehicles, buses and taxicabs), and no person shall drive any vehicle other than a passenger vehicle, as described above, on any road, highway, street or alley in the Borough (other than State Route 65, Ohio River Boulevard, Little Sewickley Creek Road and Way Hollow Road), except that nothing in this section shall prohibit the operation of any motor vehicle, truck and/or trailer, within the maximum weight limits prescribed by law, upon any street or alley in the Borough for the purpose of making local delivery or pickup of goods, wares or merchandise, within the Borough, where delivery or pickup, as the case may be, cannot be made solely by use of State Route 65, Ohio River Boulevard, Little Sewickley Creek Road and Way Hollow Road.

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $50 and costs.

§ 123-12 Traffic signals at certain intersections.

At the following intersections, official traffic signals listed below shall be erected (or are ratified if previously erected), and traffic at those locations shall be directed by those signals:

Any driver of a vehicle who disobeys the directions of a traffic signal shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 123-13 Intersections where turn prohibited on red signal.

The following are established as intersections where drivers of vehicles headed in the direction or direction indicated are prohibited from making a right turn on a steady red signal:

Any driver of a vehicle who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 123-14 Enforcement of maximum speed limits.

The Police Department of the Borough is hereby authorized to monitor, control and enforce established maximum speed limits on roads, highways, streets and alley within the boundaries of the Borough by use of the Excessive Speed Preventor (ESP) or Vascar or by such other electrical speed-timing devices or any other speed-monitoring devices now or as may be hereafter authorized by the Pennsylvania Department of Transportation and/or by state statute for use by local police authorities. The Council may, in its sole discretion, by resolution, authorize the erection of signs upon the appropriate roads, highways, streets and alleys within the Borough warning motorists that the Excessive Speed Preventor (ESP), Vascar or any other electrical speed-timing device or speed-monitoring device is being utilized thereon to enforce the established maximum speed limit.

§ 123-15 Certain left turns prohibited.

No vehicle traveling in a southerly direction on State Route 65 (the Ohio River Boulevard) may turn left onto the following Borough streets: Orchard Lane, Orchard Place and Hazel Lane. The Borough Manager is authorized and directed to cause the erection of signs along State Route 65 putting motorists on notice of this prohibition against left-hand turns.

Between the hours of 8:00 a.m. and 4:30 p.m. on regularly scheduled school days, no vehicle traveling in a westerly direction along Chestnut Road shall be permitted to make a left turn into the Edgeworth Elementary School; nor shall any vehicle exiting the Edgeworth Elementary School be permitted to turn left onto Chestnut Road.[1]

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

No vehicle traveling in a westerly direction along Hazel Lane shall be permitted to make a left turn into Sewickley Academy at the driveway approximately 230 feet from the intersection of Hazel Lane and Ohio River Boulevard.

§ 123-15.1 School zones.

Fifteen-mile-per-hour school speed zones, based on an engineering study conducted by the Pennsylvania Department of Transportation, are hereby established on the roads and in the locations as follows:

The aforementioned school speed zones of 15 miles per hour shall be effective Monday through Friday, for the following hours: 8:00 a.m. to 9:00 a.m., 11:00 a.m. to 1:00 p.m. and 3:00 p.m. to 4:00 p.m. while school is in session.

§ 123-15.2 Vehicle weight limits.

On the following streets or parts of streets, by authority granted by 75 Pa.C.S.A. § 4902(a) of the Vehicle Code, it shall be unlawful for any person or persons to drive any vehicle or combination having a gross weight in excess of the maximum prescribed below for that street or part of street, as the case may be, provided that nothing in this section shall prohibit any person from driving any of the following vehicles on the above-referenced street or parts of streets: an emergency vehicle; a truck or other commercial vehicle making local deliveries to or pickups from premises located along that street or part of a street; a school bus; or a public bus operated by a governmental body which, as of the date hereof, makes regularly scheduled passenger stops on the above-referenced streets or parts of streets within the Borough pursuant to established routes.

Additional regulations.

(a)

Legislative findings. Council has determined that pursuant to an engineering study of Borough roads, and the history and effects of vehicle traffic on Borough streets, that local traffic (local deliveries and pickups) that is conducted by vehicles over the posted weight limits is likely to damage the roads listed herein.

(b)

Alternatives. In order to protect the roads of the Borough, the local traffic exception (local deliveries and pickups) will not apply when the driving of overweight vehicles can be avoided. Two methods of such avoidance that drivers must utilize are: using a route that is available that does not use a restricted road; and splitting an overweight load into two or more smaller, compliant loads.

(c)

Notice. Notice is hereby given of the legislative findings in Subsection A(1)(a). In addition, the following will apply:

The Zoning Officer and Building Inspection Officer are directed to issue a notice to every person that applies for a zoning or building permit of this finding;

[2]

The notice will also be given to the relevant property owner, if different from the permit applicant;

[3]

The police will be given a copy of the notice that is given pursuant to Subsection A(1)(c)[1] and [2] above; and

[4]

The Borough Manager or the Borough police shall give notice to any vehicle operator in accordance with PennDOT regulations.

(d)

Permits.

If the project associated with any building or zoning permit is likely to involve overweight vehicles, the permittee and any other persons involved with the project must utilize a route to the project that is approved by the Borough Manager or Chief of Police. This requirement is in addition to any other requirements imposed by law.

Compliance with this subsection is a condition to the issuance of any building permit or zoning permit. Any notice given in connection with said permit will also include a statement to this effect.

Penalty. Any person who violates any provision of Subsection A shall be prosecuted under 75 Pa.C.S.A. § 4902(a) and (g)(1) of the Vehicle Code, and, upon conviction, shall be sentenced to pay a fine of $150 plus $150 for each 500 pounds, or part thereof, in excess of 3,000 pounds over the maximum allowable weight, and costs.

Vehicle weight limits established on all Borough streets and roads.

(1)

Due to the threat to the public safety and to the deterioration and damage to Borough streets resulting from travel by vehicles weighing in excess of 40,000 pounds, or having wheel weights in excess of 4,500 pounds, no vehicle or combination may be operated on any street maintained by the Borough of Edgeworth if the gross weight of such vehicle or combination and load exceeds 40,000 pounds; or the weight on any wheel exceeds 4,500 pounds, unless its owner or operator or a land developer contracting with its owner or operator has first obtained a permit from the Borough to do so.

(2)

The Borough may issue a permit as provided for in the preceding subsection upon the following conditions:

(a)

Application for a permit shall be made to the Borough Manager on a form to be provided by the Borough.

(b)

In the application, the applicant shall agree to be liable for the cost of repairing damage to the roadways, structures and appurtenances within the lines of any street or road or portion thereof traversed.

(c)

The permit may be conditioned as provided in 75 Pa.C.S.A. § 4962(a) of the Pennsylvania Vehicle Code.

(d)

This Subsection C(2)(d) and Subsection C(2)(e) immediately below recognize that frequent overweight trips are more damaging than isolated overweight trips and, therefore, apply to applicants who propose to make frequent overweight trips over Borough streets. "Frequent" shall mean, for purposes of this section, more than two overweight trips on a particular day. A person, firm or corporation shall be deemed to propose frequent trips if the total of proposed overweight trips in one day by his, her or its officers, employees, agents, contractors or subcontractors exceeds two; in other words, no person, firm or corporation shall avoid treatment as a frequent overweight user by having a number of different persons or entities make two or fewer overweight trips per day. To assist in determining the liability and responsibility under Subsection C(2)(b) above of an applicant proposing frequent overweight trips, and prior to the issuance of a permit or use by applicant of overweight vehicles on a Borough street, the applicant or his or her designated representative, together with the Borough Manager or his or her authorized representative, shall inspect the street or road or portion thereof to determine the condition of the base, surface, berms, signs, drainage facilities and other appurtenances and structures. Said conditions shall be noted on a form to be provided by the Borough. The applicant, together with the Borough representative, shall sign and date said form. One copy shall be given to the applicant. In addition, the applicant, at his expense, shall have the option of taking still or moving pictures of the street or road prior to the applicant's use of overweight vehicles on it, provided that such pictures are taken in the presence of the Borough Manager or representative and a copy of each picture or film is placed in the custody of the Borough. The applicant shall not be responsible for any needed repairs noted during the inspection and noted on the form.

(e)

An applicant who proposes to make frequent overweight trips over Borough streets shall file a bond with the Borough, in a form and with corporate surety acceptable to the Borough, conditioned on the repair of damage to the street or road which appears within two years after the use by the applicant of said street or road or portions thereof. The amount of the bond shall be in an amount to be determined by the Borough Manager.

(3)

Any person, firm or corporation violating any provision of this section dealing with the wheel weight shall, upon conviction thereof, be sentenced to pay a fine of $100 for each 200 pounds, or part thereof, by which the weight of any wheel exceeds 4,700 pounds, plus costs of prosecution, or in default of payment of such fine and costs, to undergo imprisonment for not more than one day for each $10 of the unpaid balance of the fine and costs.

(4)

In the event of concurrent violations of gross weight and wheel weight provisions, the only fine imposed shall be for violation of that provision which provides the greatest fine.

(5)

Upon imposition of any fine and costs of prosecution imposed pursuant hereto, the provisions of 75 Pa.C.S.A. §§ 6309 and 6310 of the Pennsylvania Motor Vehicle Code shall apply.

§ 123-15.3 Yield-right-of-way intersections established.

The following intersections are hereby established as yield-right-of-way intersections, and official yield signs shall be erected (or are hereby ratified if heretofore erected) along the first-named street, in such a position as to face traffic approaching the second-named street, in the direction or directions hereby indicated. Every driver of a vehicle approaching any such intersection upon the first-named street, in the direction or directions hereby indicated, shall yield the right-of-way to any vehicle in the intersection approaching on the second-named street so closely as to constitute an immediate hazard during the time that the operator of such vehicle is moving across or within such intersection:

Any operator of a vehicle who shall fail to yield the right-of-way, as hereinabove required shall, upon conviction thereof, be sentenced to pay a fine of $25 and costs of prosecution.

§ 123-15.4 Pedestrian crossings.

A pedestrian crossing is hereby established on Beaver Road at Nichols Field, with the center line thereof being 165 feet north of the intersection of Beaver Road and Shields Lane.

§ 123-15.5 Prohibition on use of brake retarders.

No gasoline-powered or diesel-powered motor vehicle shall be operated on Route 65 within the municipal limits of the Borough utilizing, in said operation, an engine brake, without exhaust mufflers, or with defective or modified exhaust mufflers permitting excessive noise to be created by said motor vehicle. This prohibition includes brakes that are activated or operated by the compression of the engine of the motor vehicle or any unit or part thereof (commonly referred to as Jake brakes, Jacob's brakes, engine brakes, or compression brakes).

This section shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of the Borough, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situation.

Any person, firm, corporation or organization violating any of the provisions of this section shall, upon summary conviction before a District Magistrate having jurisdiction, be sentenced to pay a fine of not more than $600 and costs of prosecution.

§ 123-15.6 Right-turn-only intersections established.

The following intersections are hereby established as right-turn-only intersections, and official signs shall be erected (or are hereby ratified if heretofore erected) along the first named street, in such a position as to face traffic approaching the second named street, in the direction or directions hereby indicated.

§ 123-15.7 Right turns prohibited.

No vehicle traveling out of Sewickley Academy at the driveway approximately 230 feet from the intersection of Hazel Lane and Ohio River Boulevard shall be permitted to make a right turn onto Hazel Lane.

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.
