[HISTORY: Adopted by the Borough Council of the Borough of
Mount Union 11-12-1979 by Ord. No. 909 (Ch. XVII of the 1980
Code of Ordinances). Amendments noted where applicable.]
That certain document, entitled the "BOCA Basic Plumbing Code/1978, Fourth Edition," as published by the Building Officials and Code Administrators International, Inc., copies of which are on file in the office of the Borough Secretary of the Borough of Mount Union, with such changes, additions and insertions as set out in § 243-2 of this chapter, is hereby adopted as the Plumbing Code of the Borough of Mount Union, for the control of buildings and structures as herein provided, and each and all of the provisions contained in the said Basic Plumbing Code, with the changes, additions and insertions hereinabove referred to, are hereby adopted and made a part of this chapter as if fully set out herein.
The BOCA Basic Plumbing Code is hereby amended and changed in
the following respects:
A.
Section P-104.1 is hereby amended to read as follows:
P-104.1 Continuation. The legal use and occupancy
of any structure existing after the effective date of this chapter
or for which it had been heretofore approved may be continued without
change, except as may be specifically covered in this code or as may
be deemed necessary by the plumbing official for the general safety
and welfare of the occupants and the public.

B.
Section P-114.0 of the said code is hereby amended to read:

P-114.0 Fees. No permit to begin work for new construction or alteration shall be issued until a fee as set from time to time by the Borough Council of the Borough of Mount Union, which shall be for the use of the Borough, shall have been paid, nor shall an amendment to a permit necessitating an additional fee because of the additional work involved be approved until the additional fee shall have been paid. Such fees shall be in addition to any fees as may be required by the Basic Building Code. (See Chapter 130.)

C.
Section P-117.4 of the said code is hereby amended to read:
P-117.4 Penalties. Any person violating any provision
of this code shall, upon conviction thereof, be sentenced to pay a
fine of not more than $300, and costs of prosecution, or, in default
of payment of such fine and costs, to undergo imprisonment for not
more than 30 days, provided that each violation of any provision of
this chapter, and each day the same is continued, shall be deemed
a separate offense.

D.
The definition of "administrative authority" in Section P-201.0 of
the said code is hereby amended to read:
Administrative authority. The person appointed
by Borough Council to the position of Code Enforcement Officer with
authority to administer and enforce the provisions of this code.

E.
Section P-303.2 of the said code is hereby amended to read:
P-303.2 Public systems available. A public water
system and/or public sewer system shall be deemed available to premises
used for human occupancy if such premises are within 250 feet, measured
along a street, alley or easement, of the public water supply or sewer
system, as the case may be, and a connection conforming with the standards
set forth in this code may be made thereto.

F.
Section P-308.3 of the said code is hereby amended to read:
P-308.3 Freezing. Water service piping and sewers
shall be installed below recorded frost penetration but not less below
grade than three feet six inches for water piping and three feet for
sewers. Plumbing piping in exterior building walls shall be adequately
protected against freezing by insulation or heat, or both.

G.
Article XV, "Individual Sewage Disposal System," is hereby deleted,
and such systems shall be governed by the rules and regulations of
the Pennsylvania Department of Environmental Protection governing
such systems.
