The following shall constitute the rates, rules and regulations governing the furnishing of water service by the Borough of Mount Union to the residents of the said Borough of Mount Union, Huntingdon County, Pennsylvania.

Hereafter, any person desiring a supply of water from the Borough of Mount Union shall make application to the Borough of Mount Union, setting forth the classification of service desired, whether commercial, industrial or domestic, the exact location of the premises upon which the water is to be consumed, and such other information as may be required for the purpose of meeting the requirements of the various ordinances of the Borough of Mount Union relating to the supply and use of water.

The Borough of Mount Union retains the tapping of mains and furnishing the corporation stop, curb stop, curb box and pipe necessary to lay the service to a point one foot past the curbline. No person other than a person authorized by the Borough of Mount Union shall make any connection with the main or distributing pipes. Prior to any connection or tapping to the mains of the Borough, any person desiring such service shall pay to the Borough of Mount Union a tapping fee in such amount as is, from time to time, established by the Borough Council of the Borough of Mount Union.

The Borough of Mount Union will run the service line from the main to and including the curb stop and curb box and the service line from the curb stop to the consumer's premises at the expense of the consumer. The consumer shall be responsible for all expenses involved in maintenance of the service line from the main to the premises of the consumer, including curb stop and curb box. All work done on the water system of the consumer will be done in compliance with the latest edition of the BOCA Basic Building Code. (See Chapter 265, Sewers.) No pipe on the property of the consumer shall cross-connect with a well or water source unless a double-check valve is installed to prevent backflow from other sources to the Borough water supply.

The Borough of Mount Union reserves the right to the use of the curb box and curb stop to shut off the water of consumers not paying their water rent or for violations of the rules and regulations.

No water will be furnished by the Borough of Mount Union to customers for commercial, industrial or domestic uses, unless the same be measured by a water meter for the purpose of ascertaining the amount of water supplied, the cost of such meter to be furnished by the Borough of Mount Union.

The Borough of Mount Union will select and approve the type of water meter to be used and shall install such meter on the service line installed by the customer.

Every meter shall be installed at an accessible location as close as possible to the point where the service enters the building and shall be kept free from any obstruction preventing ready access to it. Where the meter cannot be installed in the basement of the building, a suitable meter box with an approved metal cover shall be provided by the owner. The Borough of Mount Union shall provide one meter, at no cost, for each parcel of real estate for which water service is provided. The Borough of Mount Union shall require the payment by the owner of the costs involved in the supply of any additional water meters.
All water passing through a meter shall be charged at the established rates, and no allowance will be made for excessive consumption due to leaks or waste resulting from customer negligence or use.
In case of breakage, stoppage or any other irregularity in the meter, the owner or consumer shall immediately notify the Borough office, and any necessary repairs will be made by the Borough as hereinafter provided. If a meter for any reason fails to register the water consumed, the charge to the consumer shall be estimated on the basis of the past monthly consumption preceding the interruption of service.

In case of a disputed account involving the accuracy of the registration of any meter, the meter shall be tested by the Borough upon payment of a test charge as set from time to time by the Borough Council of the Borough of Mount Union, which charge will be returned to the customer if the meter is found to be registering four or more percent fast. If the meter is found to be registering four or more percent slow, the meter will be adjusted and corrected and the customer's bill adjusted accordingly.
The cost of ordinary maintenance and repairs to all meters will be borne by the Borough. If meters are damaged by freezing, hot water or by carelessness or neglect by the owner or occupant of the premises or their agents, the owner will be required to pay for the repairs, and if the meter is damaged beyond repair, the owner will be required to pay for a new meter, along with the cost of the installation of the same.

The Borough of Mount Union is hereby authorized at any time to shut off the water or decrease or increase the pressure, without notice, for the purpose of extending, replacing, repairing or cleaning the mains or appurtenances, or for any other purpose, without liability for any damage arising therefrom.

The Borough of Mount Union, by its proper officers or agents, shall have access, at all reasonable hours, to all premises to read the meters and to see that its rules and regulations are properly observed.
Steam boilers taking a supply of water directly from the service pipe, depending upon the hydraulic or hydrostatic pressure in the pipe system of the waterworks for supplying such boilers under working pressure, will do so at the risk of the parties making such attachments, as the Borough of Mount Union will not be responsible for any accident or damage to which such device may be subject. House boilers for domestic use must in all cases be provided with vacuum valves to prevent collapsing when the water is shut off from the distributing pipes. The Borough of Mount Union will in no case be responsible for accident or damage resulting from the imperfect action of any such valves.

The Borough of Mount Union may prohibit the use of hose for sprinkling or for any other purpose when, in its judgment, such action is necessary for the preservation of the water supply. Due notice of such restriction shall be given by publication in a newspaper of general circulation in the area served by the Borough. Should any customer fail to comply with the requirements of such notice, water service to such customer shall be discontinued, and service shall not be restored except under the provisions of Rule 20 (§ 315-21 of this article).
If directed by the owner of a property or his authorized agent, in writing, water service will be shut off or discontinued due to vacancy or other bona fide reason. No person other than an authorized employee of the Borough of Mount Union will be allowed to turn water on to any premises except in a case where the water has been shut off by direction of the owner for the purpose of making repairs to service pipes and fixtures.

No customer, except with the written consent of the Borough of Mount Union, will be allowed to furnish water to others or permit other persons to take water from his premises.
The Borough of Mount Union shall not be liable for injury or damage to person or property resulting from the use of water from its system or mains or from the failure of the supply from any cause whatsoever.

Service under any application may be discontinued for any of the following reasons:
A. 
For any tampering with the meter so as to affect its proper operation and the registration of water supplied or with seals on the meter.
B. 
For nonpayment of any account for water supplied.
C. 
For the violation of any of the rules and regulations of the waterworks.
D. 
For willful waste of water through improper or imperfect pipes, fixtures or otherwise.
E. 
When two or more consumers are supplied through a single service, any violation of these rules, with reference to either or any of said consumers, shall be deemed a violation as to all, and the Borough of Mount Union may take such action as could be taken as to a single customer.

When water has been turned off for any reason, except under Rule 16 (§ 315-17 this article), it shall not be turned on again until all unpaid charges shall have been paid and/or all violations corrected, plus payment of a charge as set from time to time by the Borough Council of the Borough of Mount Union for turning on water.

There shall be placed in the service pipe, immediately upon the wall of the building supplied, a brass stopcock and waste cock, easily accessible and at such point that all water may be drained out of the pipes for the protection of the occupants, in enabling them to turn off the water in case of leaks and to drain the pipes in order to prevent freezing, etc. The Borough of Mount Union will insist upon these stopcocks and waste cocks being so placed that they will accomplish perfectly the purpose for which they are designed.
Where more than one consumer occupies premises having only one meter, a minimum charge shall be made for each consumer, and the gallonage permitted for each rate of charge shall be multiplied by the number of consumers. For purposes of this rule, "consumer" shall be defined as a family unit or business.
No hose shall be used by flat-rate consumers from April 1 until October 1 unless the per-annum charge shall have been paid in advance. From October 1 to April 1, hose may be used by flat-rate consumers without any extra charges.

A. 
Bills for water service shall be rendered quarterly so far as practicable, on the first day of January, April, July and October, for service furnished during the previous three months, except bills for industrial service, which shall be rendered monthly. All customers will be given the option of being billed monthly. All bills will be rendered at face. The due date shall be 20 days from the date the bill is mailed, except that, for service to federal, state or local governments or to any governmental department, institution or authority, the due date shall not be less than 30 days from the date the bill is mailed.
B. 
When the due date for residential service occurs from the 21st day of the month through the 5th day of the following month, the due date may be extended, upon request, to the 6th day of the latter month for customers who are 65 years of age and older and for customers receiving social security or equivalent money checks on or about the first of the month.
C. 
If a bill is not paid within the applicable due date period, a finance charge of 1% per month may be assessed for late payment.
D. 
If a bill is not paid within 60 days from the date of the bill, the customer's water may be turned off, after notice, and will not be turned on again until all back bills and rentals, plus a turn-on charge as set from time to time by the Borough Council of the Borough of Mount Union, have been paid. All customers must keep the Borough of Mount Union advised of their correct address. Failure to receive bills will not be considered an excuse for nonpayment. In the interpretation of this rule, payment by mail will be accepted, provided it bears a postmark within the period prescribed above.

All water bills shall be a charge against the property and shall remain so until paid; bills shall be mailed to or delivered to the owner or owners of the property on which the water is consumed and shall be paid by them. If bills for water are not paid within three years, a municipal lien for the amount of the bill shall be entered against the property, as permitted by the Act of Assembly approved June 4, 1901, P.L. 364, and its amendments and supplements thereto.[1]

From and after July 1, 1979, no new service shall be installed wherein more than one customer is to be supplied through a single service. All new installations after July 1, 1979, shall require a separate service for each customer.

Rates shall be as set from time to time by the Borough Council of the Borough of Mount Union.
