From and after the effective date of this article, all person or persons, corporations, partnerships, and any other business entities who rent or lease any parcel of real estate, in whole or in part, to any other person or persons, corporations, partnerships or other business entities shall be required to prepare and file with the Borough Secretary a list of all said lessees who have rented real estate from said owner or owners during the preceding six months. Said list shall be certified by the owner.
The certified list of all renters shall include the name and last known address of each person 18 years or older who resided in said rental real estate for all or a portion of said six-month period. The list shall be filed semiannually on a form supplied by the Borough, the deadlines for said semiannual filing being January 31 and July 31 of each and every calendar year.
For the purpose of this article, the fact that the owner of real estate rents or leases any property for minimal or no rent to another person shall not exclude said owner from filing the certified list required in ยงย 258-1.
Every owner of real estate who fails to so comply with the requirements of this article will, upon conviction, be guilty of a summary offense and be liable for a fine not to exceed a maximum of $300 or a minimum of $100. For the purpose of this article, every day that an owner of real estate is late in filing said certified list as required above shall constitute a separate offense.
This article shall become effective August 1, 2003. The first filing pursuant to this article shall be required to be filed by January 31, 2004, for the last six months of 2003.
