Every owner of property in the Borough of Mount Union shall,
on 15 days' notice from the Borough Council, construct or reconstruct
a sidewalk and/or curb, which shall conform to all applicable requirements
of this article, in front of or alongside such property.
Every owner of property in the Borough of Mount Union shall,
on 15 days' notice from the Borough Council, repair the sidewalk
and/or curb, in the manner stipulated in such notice, in front of
or alongside such property.
All sidewalks and curbs shall be constructed, reconstructed
and repaired of concrete only, according to specifications determined
from time to time by the Borough office, provided that, where the
existing sidewalk is of brick and was constructed of such material
pursuant to the provisions of an ordinance in effect at the time of
such construction, such sidewalk may be repaired of the same material,
in lieu of concrete, if at least 2/3 of the area of such sidewalk
is in good repair.
All sidewalks shall be not less than five feet in width, measured
from the curbline of the street inwardly toward the lot, including
the completion of the sidewalk within the angle formed by the intersection
of streets in case of corner lots, provided that, in each location,
the precise required width, within the above-cited minimum, shall
be determined and specified by the Borough Code Enforcement Officer.
All sidewalks and curbs shall be constructed, reconstructed and repaired and the grading thereof done upon the line and grade obtained by the property owner from the specifications designated by Council from time to time, a copy of which shall be kept for inspection in the Borough office. Upon notice, as provided in §§
288-1 and
288-2 of this article, as the case may be, such work of construction, reconstruction or repair shall be done by the owner of such property.
It shall be the duty of the Borough, or an authorized agent
of the Borough, to determine, in the case of any individual property,
whether or not the sidewalk and/or curb shall be reconstructed or
repaired and, if so, the specific part or parts thereof to be reconstructed
or repaired.
If any property owner shall neglect to comply with any of the
provisions of this article, the Borough may, after notice, cause the
construction, reconstruction and/or repairing to be done, or, in the
case of improper work, to be redone, at the expense of such owner
and collect from such owner all charges and expenses thereof, plus
10%, in the manner provided by law.
Any person violating any provision of this article shall, upon
conviction thereof, be sentenced to pay a fine of not more than $300,
and costs of prosecution, or, in default of payment of such fine and
costs, to undergo imprisonment for not more than 30 days, provided
that each violation of this article, and each day the same is continued,
shall be deemed a separate offense.
