A.
GARBAGE
HAULER

RUBBISH
SOLID WASTE
As used in this article, the following terms shall have the meanings
indicated:
Solid waste resulting from animal, grain, fruit or vegetable
matter used or intended for use as food.
Any person who has been licensed by the Borough to collect,
transport and dispose of refuse for a fee as herein prescribed.
Any natural person, association, partnership, firm or corporation.
All materials which are discarded as useless.
All solid waste except garbage and other deteriorating matter,
including, but not limited to, ashes, bedding, cardboard, cans, crockery,
glass, paper, wood, and yard cleanings.
Garbage, refuse and other discarded materials, including,
but not limited to, solid and liquid waste materials resulting from
industrial, commercial, agricultural and residential activities.
B.
In this article, the singular shall include the plural, and the masculine
shall include the feminine and the neuter.

All agreements for the removal and collection of rubbish, garbage
or refuse shall be by private contract between the individual citizen
and a hauler licensed for the purpose of collecting, removing and
disposing of such rubbish, garbage and refuse.
A.
Preparation of refuse. All garbage, before being placed in refuse
containers, shall be drained free from all liquids and shall be wrapped
in several thicknesses of paper.
B.
Refuse containers.
(1)
Refuse receptacles shall be kept as sanitary as possible and shall
be thoroughly cleansed by the owner periodically after collections.
(2)
All refuse receptacles shall be provided by the owner, tenant or
occupant of the premises.
(3)
No person shall use a refuse receptacle having a capacity of more
than 32 gallons.
(4)
It shall be the duty of the refuse collector to handle all containers
carefully and to replace the lid on containers after each collection.
Failure to comply with such requirement shall constitute a violation
of this article.
C.
Storage of garbage and refuse.
(1)
No person shall place any garbage or refuse in any street, alley
or other public place or upon any private property within the limits
of the Borough, except if same are placed in a proper refuse container.
(2)
Any unauthorized accumulation of refuse on premises is hereby declared
to be a nuisance and is prohibited.

A.
Place of collection. Refuse receptacles and bagged or wrapped garbage
or solid waste for collection purposes shall be placed at ground level
on the property at a point on such property adjacent to the curb on
the main street abutting said property. Such refuse receptacles and
bagged or wrapped garbage or solid waste shall be placed at curbside
not more than 24 hours before the scheduled time of pickup.

A.
No person except a licensed hauler shall collect garbage or refuse
from any other person, nor shall any person except a licensed hauler
haul any refuse or garbage for any other person for a fee or remuneration
within the corporate limits of the Borough of Mount Union.
B.
The Borough Council, upon application and after investigation, may
issue a license to a hauler for a period of one year, effective July
1 of each and every year. The fee for such license shall be as set
from time to time by the Borough Council of the Borough of Mount Union.
Any hauler desiring to secure a license shall present a written application
indicating such desire to the Borough Council, and such license shall
be issued only after proper action by the said Borough Council. In
order to promote the health and welfare of the residents of the Borough
and to regulate the hauling of garbage and refuse, the Borough Council
reserves the right to limit the number of licenses issued in accordance
with the terms of this article.

C.
No person licensed as a hauler by the Borough of Mount Union shall
dump or deposit any garbage or refuse at any point other than the
sanitary landfill operated by Delta Disposal and Quarries, Inc., in
Franklin Township, Huntingdon County, Pennsylvania, the use of which
has been obtained through contract by the Borough of Mount Union with
Delta Disposal and Quarries, Inc.
D.
No person licensed as a hauler by the Borough of Mount Union shall
dump or deposit any garbage or refuse at any point other than the
disposal facility designated by the Bedford-Fulton-Huntingdon Solid
Waste Authority, or other disposal facility licensed by the Commonwealth
of Pennsylvania.
E.
No person residing within the corporate limits of the Borough of
Mount Union shall permit any unlicensed hauler to remove garbage or
refuse for a fee or remuneration from premises owned or occupied by
him.
F.
Each licensed hauler must furnish the Borough of Mount Union with
a true and correct list of each of its customers within the corporate
limits of the Borough of Mount Union, with the charge being levied
upon each customer. The list must be in alphabetical order and kept
current on a monthly basis.

No licensed hauler shall permit any outfallings from any vehicles
used for the collection and conveyance of garbage or refuse to lie
or remain upon any of the streets or alleys in the Borough or on any
street, road or property between the corporate limits of the Borough
and the disposal facility designated by the Bedford-Fulton-Huntingdon
Solid Waste Authority, or other disposal facility licensed by the
Commonwealth of Pennsylvania.
All vehicles used for collection of garbage shall have enclosed
bodies or suitable provision for covering the body and shall have
watertight bodies of easily cleanable construction, shall be cleaned
at sufficient frequency to prevent nuisance or insect breeding and
shall be maintained in good repair. All vehicles used for garbage
collection and conveyance shall be subject to inspection as required
from time to time by the Borough Council.

A.
No person shall hereafter dispose of any garbage or refuse collected
within the corporate limits of the Borough of Mount Union except at
the disposal facility designated by the Bedford-Fulton-Huntingdon
Solid Waste Authority, or other disposal facility licensed by the
Commonwealth of Pennsylvania.
B.
All licensed haulers will be required to enter into an agreement
with the Borough of Mount Union by which each licensed hauler shall
agree to comply with all rules and regulations as promulgated by the
disposal facility designated by the Bedford-Fulton-Huntingdon Solid
Waste Authority, or other disposal facility licensed by the Commonwealth
of Pennsylvania.
From and after the effective date of this article (November
1, 1979), any refuse collection or disposal within the Borough of
Mount Union, except as herein provided, shall constitute a violation
of this article.
Any person who shall violate or fail to comply with any of the
provisions of this article shall, upon summary conviction thereof,
be sentenced to pay a fine of not more than $300 and costs of prosecution,
provided that each day's continuance of a violation of this article
shall constitute a separate offense.
This article shall become effective November 1, 1979.
