The said park (on former brick plant site, purchased from General Refractories Company) be and it is hereby named "Municipal Park."

The following rules and regulations are hereby prescribed relative to the use of all of the public parks in the Borough of Mount Union, Huntingdon County, Pennsylvania, operated by the said Borough of Mount Union:
A. 
All parks shall be open to the public at 6:00 a.m. and shall be closed at 10:00 p.m. It shall be unlawful for any person to be on park premises except during these hours unless by permission granted by the said Borough of Mount Union.
B. 
It shall be unlawful to operate or park a motor vehicle on any park premises, except in those areas specifically designated for the operation or parking of motor vehicles.
C. 
It shall be unlawful for the owner or operator of any motor vehicle to park upon park premises between the hours of 10:00 p.m., prevailing time, and 6:00 a.m., prevailing time, except in conjunction with organized activities as provided for in Subsections A and H hereof.
D. 
It shall be unlawful for any person to possess or use alcoholic beverages of any type on park premises, except in any of the buildings located on park premises in conjunction with organized activities as provided for in Subsection H.
E. 
It shall be unlawful to build or maintain fires on the park premises, except in containers or cooking devices provided for such purpose.
F. 
It shall be unlawful to deposit or dispose of litter, trash, garbage or material of any kind on the park premises, except in appropriate receptacles provided for such disposal.
G. 
It shall be unlawful to operate a motor vehicle on any park premises in excess of five miles per hour.
H. 
It shall be unlawful to hold or conduct any organized activity upon park premises unless special permission has been granted by the Borough Council of the Borough of Mount Union.
I. 
Application for special permission as required by Subsections A and H shall be made to the Borough Manager of the Borough of Mount Union.
J. 
It shall be unlawful for any person to operate a motor vehicle on any park premises at any time unless such person possesses a duly and properly issued operator's license.
K. 
It shall be unlawful for any person to operate a motor vehicle on any park premises unless such vehicle bears a duly issued and current registration plate.

A. 
Any person who shall violate the provisions of § 232-2A, B, D, E, F, G and H hereof shall, upon conviction thereof, be subject to a fine of not less than $10 nor more than $50.
B. 
Any person who shall violate the provisions of § 232-2J hereof shall, upon conviction thereof, be subject to a fine of $200.
C. 
Any person who shall violate the provisions of § 232-2K hereof shall be subject to a fine of $25.

As used in this article, the following terms shall have the meanings indicated:
PUBLIC PARK
Any outdoor park within the Borough of Mount Union owned, leased, maintained or operated by the Borough of Mount Union.
SMOKING
The carrying by a person of a lighted cigar, cigarette, pipe or other lighted smoking device.
Smoking is hereby prohibited in all public parks within the Borough of Mount Union, except in those areas specifically designated by the Borough as smoking areas. Smoking areas shall be designated by clear and conspicuously posted signage.
A. 
Any person who violates the provisions of this article shall, upon conviction, be guilty of a summary offense and shall be sentenced to pay a fine of not less than $25 nor more than $300, along with the costs of prosecution.
B. 
Each time a person engages and/or reengages in smoking at a public park shall be considered a new offense for the purposes of prosecution under this article.
