The Colwyn Borough Volunteer Fire Company, organized and existing in the Borough of Colwyn, Delaware County, Pennsylvania, is hereby designated as the officially recognized volunteer fire company for the Borough of Colwyn.
A. 
The Colwyn Borough Volunteer Fire Company, its officers, members, and fire police, are hereby authorized to provide such services to the Borough of Colwyn as may be necessary for the protection of property and persons situate therein, which include, by way of example and not of limitation, the extinguishment and prevention of loss of life and property from fire, automobile accidents, medical emergencies, hazardous material incidents, and other dangerous or emergency situations. The Colwyn Borough Volunteer Fire Company, its officers, members, and fire police, may also provide nonemergency and public service functions, such as, again by way of example and not of limitation, removing water from property after storms, and assisting in the removal, abatement and prevention of damage or injury to persons or property, whether through natural causes or man-made situations.
B. 
The Colwyn Borough Volunteer Fire Company may also conduct and participate in such training activities and drills, either within or outside of the Borough of Colwyn, as may be deemed necessary by its officers to maintain proficiency in providing services and may also respond to fire and other emergency calls and provide services to municipalities outside the Borough of Colwyn.
In addition to actually participating in the activities of the fire company as authorized above, or in going to or returning from any activity, officers, members, and fire police of the Colwyn Borough Volunteer Fire Company are also authorized to do the following things:
A. 
Engage in any type of drill, training ceremony, practice, test or parade, when duly called for or authorized by an officer or of the fire company.
B. 
Engage in fund-raising activities for the fire company, when authorized by an officer or officers of the fire company and the Borough of Colwyn.
C. 
Participate in parades, ceremonies, conferences, or trade shows within 100 miles of Colwyn Borough, provided that the participation in each ancillary event is approved in advance by the Colwyn Borough Volunteer Fire Company Fire Chief and to engage in the foregoing ancillary activities when the activities are further than 100 miles if that participation is additionally approved by the Colwyn Borough Council.
A. 
The Colwyn Borough Volunteer Fire Company shall have the right to attend and assist at fires in neighboring municipalities.
B. 
No liquor, beer, or other alcoholic beverages shall be sold, given away, stored or consumed on the premises of the Colwyn Borough Volunteer Fire Company at any time.
C. 
No equipment, fire trucks or property, real or personal, of the Colwyn Borough Volunteer Fire Company shall be sold, leased or transferred without the consent of the Colwyn Borough Council first had and obtained.
D. 
The buildings housing the Colwyn Borough Volunteer Fire Company shall not be leased to any club, organization, or party which plans to use or permit the use of intoxicating liquor at any time.
A. 
Borough Council recognizes the existence of the Volunteer Firefighters' Relief Association ("Association") of the Colwyn Borough Volunteer Fire Company and has certified to the Auditor General that such Association is in fact a bona fide volunteer firefighters' relief association affiliated with the Colwyn Borough Volunteer Fire Company, which fire department affords protection against fire to the entire Borough.
B. 
The Volunteer Firefighters' Relief Association shall have the right to solicit and receive gifts and contributions from any source, including municipal corporations.
C. 
Having been certified by the Borough Council to the Auditor General, the Association may receive a portion of the moneys distributed to the Borough under the provisions of the Municipal Pension Plan Funding Standard and Recovery Act, Public Law 1005, No. 205, Chapter 7, enacted December 18, 1984 (53 P.S. § 895.701).
D. 
Pursuant to Act 307 of April 25, 1929 and 72 P.S. § 7902, the Borough, upon receiving payment from the State Treasurer of the entire net amount received from the two-percent tax paid to the Pennsylvania Department of Revenue by every insurance company doing business in the Borough, shall pay that amount received to the Relief Fund Association of the fire department or company in the Borough so recognized by Council, which fund shall be distributed and used for firefighters' relief pension or retirement purposes.
