[HISTORY: Adopted by the Borough Council of the Borough of Northampton 7-10-1980 by Ord. No. 934 (Ch. 1, Part 6, of the 1993 Code of Ordinances). Amendments noted where applicable.]
There hereby is established an Educational Service Agency in the Borough of Northampton.
The Educational Service Agency shall be composed of the Borough Manager, the Police Chief and the Borough Treasurer. Provided, that the three individuals who are appointed at the time of the establishment of the Educational Service Agency, that one term shall expire on the first day of January of the first year after the establishment of the Agency, that the term of one member shall expire on the first day of January after the second year of the establishment of the Agency, and that the term of one member shall expire on the first day of January after the third year of the establishment of the Agency. All subsequent appointments shall be for three-year terms coinciding with the calendar year.
No elected Borough or school district official shall be eligible for appointment or membership on the Educational Service Agency.
The members of the Educational Service Agency shall not receive any additional compensation for serving on this Agency other than their regular rate of pay as fixed from time to time by Borough Council.
The function of the Educational Service Agency shall be to employ and supervise school crossing guards also referred to as special school police to direct traffic at and/or near schools. In order to enable the Educational Service Agency to perform that function, the Borough delegates to the Educational Service Agency the authority to appoint and supervise crossing guards or special school police as set out in the Borough Code.
The Educational Service Agency shall have the following authority and duties:
A. 
Submit a recommendation to Borough Council each year on the amount of revenue needed for the employment of school crossing guards (this can be included in the annual budget submitted by the Borough Manager); employ and/or discharge crossing guards or special school police to serve in the Borough.
B. 
Exercise supervision and control over crossing guards or special school police by:
(1) 
Establishing, administering, and enforcing rules and regulations for the work and conduct of the crossing guards or special school police;
(2) 
Establishing work schedules and designating the locations where and the time when the various individuals are to be on duty;
(3) 
Providing the supervision as necessary;
(4) 
Exercising any and all other prerogatives normally associated with personnel management.
C. 
Make all payments for the services of school crossing guards or special school police and make all other expenditures as prescribed by law. These payments can be made through the regular accounting procedure of the Borough.
D. 
Receive, in addition to payments by the Borough, any payments by the school district or any other gift, grant, devise, or bequest.
E. 
Establish a system of accounts for all moneys under its control, and establish one or more separate bank accounts into which all income shall be deposited and from which all expenditures shall be made. The Agency can use the regular accounting procedures and accounts within the general fund if they so desire.
The Borough shall transfer and pay over to the Educational Service Agency the moneys that the Borough is required to pay as compensation to special school police under the Borough Code, or other agreement executed with the School District, as provided in the Borough Code, as well as other moneys as necessary to cover expenditures budgeted, for the Educational Service Agency as provided in § 15-8 in this article. If the Agency so desires, the accounts can be set up as part of the regular budget accounts in the general fund.
The Educational Service Agency hereby recognized and formally established shall continue until changed or abolished by action of the Borough or until the suspension of Act 108 of 1979[1] as adopted by the legislature of the Commonwealth of Pennsylvania in accord with the terms thereof.
