Wherever a space is marked off on any street for the parking
of an individual vehicle, every vehicle parked there shall be parked
wholly within the lines bounding that space, and it shall be a violation
of this article for any person to park a vehicle or allow it to remain
parked otherwise.

Definitions. As used in this section, the following terms shall have
the meanings indicated:
A bus designed to transport passengers and on which passengers
are authorized to be transported, consisting of two or more units
or sections permanently assembled in tandem by flexible connections,
which permit passenger movement throughout the length of the bus.
A small vessel for travel on water.
A towing trailer with wheels designed to house a boat inside,
so that a boat may be transported above ground.
Two or more vehicles physically interconnected in tandem.
A truck engaged in construction operations, such as paving
trucks, plowing trucks, landscaping trucks, and/or similar vehicles.
A vehicle designed or used exclusively for agricultural operations
and only incidentally operated or moved upon highways, including,
but not limited to, farm tractors, choppers and balers.
A trailer so constructed that no part of its weight rests
upon the towing vehicle. A semitrailer attached to a towing vehicle
by means of an auxiliary front axle or dolly shall be deemed to be
a full trailer.
A trailer, which is designed, constructed and equipped as a
dwelling place, living abode or sleeping place (either permanently
or temporarily) and is equipped for use as a conveyance on streets
and highways.
A trailer containing a chassis and exterior shell designed and constructed for use as a house trailer, as defined in Subsection (1), but which is used permanently or temporarily for advertising, sales, display or promotion of merchandise or services, or for any other commercial purpose except the transportation of property.
A motor vehicle designed for carrying no more than nine passengers,
exclusive of the driver, and used for the transportation of persons
for compensation.
A combination. The truck may have either a detachable or
permanently attached cargo box. The cargo box on the trailer shall
be designed such that the truck may be loaded and unloaded through
the trailer. Neither cargo box shall exceed 34 feet in length and
the overall length of the combination shall not exceed 65 feet.
A motor vehicle designed or adapted for use as a mobile dwelling
or office, except a motor vehicle equipped with a truck-camper.
Any motor vehicle designed for use off of a main or paved
road.
A vehicle designed with a pickup truck base, that has a camper
attached to the bed of the truck.
A trailer designed or adapted and used exclusively for recreational
purposes.
A trailer so constructed that some part of its weight rests
upon or is carried by the towing vehicle.
Any various automotive vehicles for travel on snow.
A compact trailer that opens up into a tent or camper.
A trailer designed and used exclusively to tow another vehicle
by mounting its front or rear wheels on the tow dolly while the other
wheels of the towed vehicle remain in contact with the ground.
A vehicle designed to be towed by a motor vehicle.
A structure designed, used or maintained primarily to be
loaded or affixed to a motor vehicle to provide a mobile dwelling,
sleeping place, office or commercial space.
A motor vehicle designed and used primarily for drawing other
vehicles and not so constructed as to carry a load other than a part
of the weight of the vehicle and load so drawn.
Every device in, upon or by which a person or property is
or may be transported or drawn upon a highway, except devices used
exclusively upon rails or tracks.
B.
Unlawful parking. It shall be unlawful for any person or entity to
park any articulated buses, boats, boat trailers, buses, combinations,
commercial construction trucks, (unless a single vehicle is used exclusively
for traveling to and from work), farm equipment, full trailers, house
trailers, limousines, maxi-cube vehicles, motor homes, off-road vehicles,
pickup campers, recreational trailers, semitrailers, snowmobiles,
tent trailers, tow dollies, trailers, truck-campers or truck tractors
on any street or alley in the Borough, or to allow it to remain parked
there, at any time. This prohibition shall not apply to any emergency
vehicle/truck during an emergency, or any vehicle/truck temporarily
parked to service a residential zone, i.e., moving households. "Temporary"
shall be defined as no more than eight continuous elapsed hours in
one day.

A.
It shall
be unlawful for any owner of any type of motor vehicle requiring a
registration plate and/or a state inspection sticker, under 75 Pa.C.S.A.
§ 101 et seq., known as the "Vehicle Code," to park a vehicle
or to permit said vehicle to be parked on any public street, public
alleyway, or public property within the limits of the Borough of Northampton
if said motor vehicle does not have attached to it a valid registration
plate and/or a valid inspection sticker.

A.
It shall

A.
Guidelines and purpose.
(1)
On-street handicap/disabled veteran parking spaces located in residential
neighborhoods of the Borough of Northampton shall be governed by the
Pennsylvania Vehicle Code, Sections 1342, 1338, 3354, (75 P.S. §§ 1342,
1338, 3354). Commonwealth of Pennsylvania, Department of Transportation,
Bureau of Motor Vehicles has provided forms MV-145A and MV-145V to
assist all handicapped residents of Pennsylvania in applying for the
proper relief.
(2)
The Borough Council ("Council"), upon the recommendation of the Chief
of Police, is hereby authorized to make all determinations with respect
to establishment, continuation and removal of handicapped parking
spaces. This authority is applicable to preexisting handicapped spaces,
their continuation and removal, notwithstanding that such spaces were
previously established and authorized. Anyone aggrieved by the determination
of Council may request reconsideration by filing said request within
15 business days of Council's decision.
(3)
It is not the obligation of the Borough of Northampton to provide
off-street or on-street private parking for residents of the Borough
with or without disabilities. Owners of apartment buildings shall
make every effort to establish off-street parking for their tenants.
(4)
Any handicap parking space created is available for use by any vehicle
displaying a valid handicap registration plate or placard.
(5)
All persons requesting a handicapped parking space must submit an
application and all supporting documentation to the Chief of Police
for consideration prior to Council approval. The above mentioned forms
(MV-145A and MV-145V) along with an application will be adapted as
an aid to control the issuing of handicapped parking spaces within
the Borough limits.
(6)
Applications for designation of handicap/disabled veteran parking
space in residential neighborhoods shall be considered on a case by
case basis using, but not limited to, the following guidelines:
(a)
The applicant must reside at the address and prove the need
for the requested sign.
(b)
The applicant must own and drive a vehicle, possess a valid
handicapped license plate or placard.
(c)
All on-street parking restrictions, such as sweeper, snow emergency
routes, school zones, shall apply and be obeyed.
(d)
The Chief of Police shall review the status of all on-street
handicap/disabled veteran-parking areas on an annual basis to assure
that the need for the parking space continues to exist.
(e)
Applicants shall not have a driveway or garage for parking their
vehicle off-street.
(f)
Handicapped parking space will only be allowed if parking is
permitted in the front of or on the side of the residence.
(7)
Upon the death of a handicapped person to whom a parking space has
been issued under this section, the parking space shall be void 30
days after death and revoked by the Council by resolution as of said
date.
B.
Criteria and conditions.
(1)
No space shall be granted where adequate, handicapped accessible
off-street parking is available to the applicant.
(2)
Applicant must have one or more of the below listed handicaps and
be physically disabled as determined by the Department of Transportation,
Bureau of Motor Vehicles:
(a)
Person who is blind;
(b)
Person who does not have full use of an arm or both arms;
(c)
Person is wheelchair confined;
(d)
Person is unable to walk a distance of 200 feet without stopping
to rest (applicant may be asked to perform this and/or produce documentation
verifying this condition);
(e)
Person cannot walk without the use of, or assistance from, a
brace, cane, crutch, another person, prosthetic device, wheelchair
or other assistive device;
(f)
Person is restricted by lung disease to such an extent that
the person's forced (respiratory) expiratory volume for one second,
when measured by spirometry, is less than one liter or the arterial
oxygen tension is less that 60 mm/hg on room air at rest;
(g)
Person uses portable oxygen;
(h)
Person has a cardiac condition to the extent that the person's
functional limitations are classified in severity as Class III or
Class IV according to the standards set by the American Heart Association;
(i)
Person is severely limited in his or her ability to walk due
to an arthritic, neurological, or orthopedic condition;
(j)
The person has severe cardiopulmonary insufficiency requiring
the use of ambulatory equipment;
(k)
The person requires the use of prosthetic devices that restricts
normal ambulation;
(l)
The person has other physical or mental limitations that the
Council believes are severe enough to warrant a handicapped parking
space; and
(m)
The person requesting a space is caring for or in loco parentis
of a person specified in the above subsections.
(3)
The applicant requesting the handicapped parking space must first
obtain either a disability registration or qualify for a disabled
placard, and shall exhibit proof of the issuance of or qualification
of a handicapped person's or severally disabled veteran's license
plate or place card under the regulations of the Pennsylvania Department
of Transportation.
(4)
An applicant may register one vehicle with a gross weight not to
exceed 6,000 pounds.
(5)
No more than one handicapped parking spaces shall be established
upon any one individual application.
(6)
No handicapped parking space shall be allowed along a street or portion
thereof where parking is prohibited, or which is of an insufficient
width, or where the physical conditions of the street or traffic conditions
would make it unsafe for a handicapped parking space for access and
use by a handicapped/disabled person.
(7)
No handicapped parking space shall be created or continued unless
it can be demonstrated that the applicant's physical condition justifying
such a parking space is reasonable expected to persist for a period
of not less than one year.
(8)
For the establishment or continuation of a handicapped parking space,
a report from the applicant's treating physician may be considered,
but any such report without more shall not be considered conclusive.
Any such medical report shall be independent and reliable, and otherwise
not be from a physician whom is familiarly related to the applicant.
(9)
In the event there is a material improvement in the physical condition
of the applicant to the extent that the applicant would no longer
qualify as a handicapped person or severely disabled veteran under
the criteria set forth herein, the handicapped parking space shall
be removed. Likewise, the handicapped parking space shall be removed
if there is a change in the circumstances or conditions, such as the
applicant's death or moving to another location, such that the handicapped
parking space shall no longer be necessary or otherwise appropriate
under the criteria referred to herein.
C.
Location of handicapped parking space/spaces.
(1)
No more than two handicapped parking spaces shall be located on any
block where parking is permitted on both sides of the street.
(2)
No more than one handicapped parking space shall be located on any
block where parking is permitted on only one side of the street.
(3)
All handicapped parking spaces permitted prior to the effective date
of this ordinance shall be allowed to remain as located but must be
renewed annually beginning January 1, 2008.
(4)
In the event previously permitted spaces exceed the maximum allowed
per block, the Council shall refrain from granting any additional
spaces in that block until the number of handicapped spaces falls
below the maximum allowed.
(5)
The Council shall solely determine the particular location of the
handicapped parking space within the street, and shall have the appropriate
signs or street or curb markings placed thereat.
(6)
The discretion of the Borough to establish handicapped parking areas
at other locations where the Council deems appropriate or to continue
preexisting handicapped parking spaces is not limited hereby.
D.
New application.
(1)
Applicant must complete an application form and forward all supporting
documents to the Borough Hall, attention: Chief of Police. Supporting
documents include but not limited to the following: copy of operator's
license showing the address where the parking space is being requested,
a signed copy of the form MV-145A or MV-145V, copy of the car registration,
copy of handicap license plate, copy of handicap placard, copy of
disabled veteran license plate, medical doctor documentation, etc.

(2)
A resident of Northampton or other individual requesting an on-street
handicapped parking space within the Borough shall submit an application
to the Council. All applications so submitted shall be reviewed for
approval or rejection by the Council by recommendation of the Chief
of Police under the criteria and conditions herein set forth.
(3)
An incomplete application form or failure to provide all necessary
supporting documentation may result in rejection of the request.
(4)
Applications shall be reviewed by the Chief of Police, who will make
a final recommendation to Council, who will make final decision regarding
granting a handicapped parking space.
E.
Renewal application.
(1)
Each permit for a handicapped parking space shall be renewed on an
annual basis.
(2)
Applications for renewal shall complete the application form and
forward all supporting documents to the Chief of Police. Supporting
documents include: copy of operator's license showing the address
where the parking space is being requested, a signed copy of the form
MV-145 or MV-145A, copy of the car registration, copy of handicap
license plate, copy of handicap placard veteran license plate, medical
doctor documentation, etc.
(3)
Renewal applications shall be submitted to the Chief of Police between
January 1 and January 31 of each calendar year.
(4)
In making the final determination regarding the renewal of a previously
permitted handicapped space, the Council shall apply the criteria
contained in this policy.
(5)
Once a permit is not renewed for any reason, any future application
by the same applicant shall be considered a new application and shall
be governed by the new application provisions of this policy.
F.
Revocation of space and violations.
(1)
The Council reserves the right to revoke and and/or deny any permit
for a handicapped parking space at any time for any reason.
(2)
Any person violating the provisions of this section shall be deemed
guilty of a summary offense and punished by a fine of not more than
$600, plus costs of prosecution.
(3)
Any vehicle found to be in violation of the provisions of this section
shall, upon the direction of any police officer of the Borough of
Northampton, be towed at the owner's sole cost and expense.
G.
General provisions. Under extraordinary circumstances, the Council
may allow handicapped parking spaces other than as set forth herein.
It shall be unlawful for any person to stop, stand or park a
vehicle (other than a pedalcycle) on the roadway side of any vehicle
stopped or parked at the edge or curb of any street, except that standing
or parking for the purpose of loading or unloading persons or property
shall be permitted on the following named streets on Monday through
Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between
the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary
for the loading or unloading.

A.
Findings and purpose. The Borough finds that:
(1)
Certain residential areas in the Borough are subjected to commuter
vehicle parking, therefore depriving the residents of those areas
of spaces in which to park their own vehicles;
(2)
Those residential streets are also subjected to a high degree of
commuter traffic which substantially reduces the quality of the ambient
air level; and
(3)
The establishment of a parking permit program for certain affected
areas should facilitate efficient movement of traffic by providing
for parking preference during certain hours of the day and days of
the week. Therefore, the Borough considers it to be in the interest
of the people of the Borough to provide for the establishment of a
residential permit parking program to insure primary access to available
parking spaces by neighborhood residents and also to provide a cleaner
ambient air level.
B.
COMMUTER VEHICLE
PROPRIETOR
RESIDENT
RESIDENTIAL AREA
Definitions. For the purpose of this section, words and terms listed
in this subsection, as follows, shall have the following meanings:
A motor vehicle parked in a residential area by a person
not a resident of that residential area.
A person who owns or leases real estate within a residential
area of which he is not a resident, but who owns or manages a business
enterprise or professional office maintained at that address; for
the purpose of this section, a proprietor shall be entitled to one
parking permit for that business or professional office address.
A person who owns or leases real property within a residential
area and who maintains either a voting residence, or bona fide occupancy,
or both, at that address.
A contiguous area containing public highways or parts of
public highways primarily abutted by residential property or residential
and nonbusiness property (such as schools, parks, places of worship,
hospitals and nursing homes).
C.
Criteria. The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1)
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday
through Saturday, except legal holidays, the number of vehicles parked
(or standing), legally or illegally, on the streets in the area is
equal to 70% or more of the legal, on-street parking capacity of the
area. For the purpose of this criterion, a legal parking space shall
be 20 linear feet.
(2)
During the same period as specified in Subsection C(1), directly above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Bureau of Motor Vehicles and Licensing of the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used. Provided: in determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(a)
The local and metropolitan needs with respect to clean air and
environment;
(b)
The possibility of a reduction in total vehicle miles driven
in the Borough;
(c)
The likelihood of alleviating traffic congestion, illegal parking
and related health and safety hazards;
(d)
The proximity of public transportation to the residential area;
(e)
The desire and need of the residents for residential permit
parking and their willingness to bear the administrative costs in
connection with it; and
(f)
The need for parking in excess of the residential permit parking
program in proximity to establishments located in the residential
permit parking area and used by the general public for religious,
health or educational purposes.

Signs shall be erected along the streets in each residential permit
parking area, indicating the days, hours, locations and conditions
under which parking shall be by permit only.
E.
Application for permit. Application for a residential parking permit
shall be made to the Chief of Police by the person desiring the permit,
who shall be only the owner or the driver of a motor vehicle who resides
on or is a proprietor of property immediately adjacent to a street
or other location within a residential parking permit area. A separate
application shall be required for each motor vehicle, and each application
shall be accompanied by a permit fee, set pursuant to a resolution
of the Borough Council, which shall be for the use of the Borough,
to be applied to the cost of administering the residential permit
parking program. Each application shall contain the following information:
the name of the owner or the driver, as the case may be, of the motor
vehicle; the address of the resident or the proprietor, as the case
may be; the make, model and registration number of the motor vehicle;
and the driver number as taken from the applicant's current driver's
license. At the discretion of the Chief of Police, the applicant shall
be required, at the time of making application, to present his driver's
license and the vehicle registration card.
F.
Issuance of permit. Upon receipt of the application and the permit
fee, and determination by him that the information upon the application
shows that the applicant is entitled to a residential parking permit,
the Chief of Police shall issue to the applicant a residential parking
permit, which shall be valid for the remainder of the calendar year.
The permit shall display the serial and registration numbers of the
motor vehicles, the residential parking area number, and the expiration
date. The permit shall be renewable annually before the expiration
date, upon making application for renewal and payment of the permit
fee. It shall be unlawful and a violation of this section for any
person to display other than the current and valid permit while standing
or parking in a residential permit parking area at any time when those
permits are to be displayed.
G.
Temporary and exemption parking permits. Temporary parking permits
may be issued by the Chief of Police, upon payment of a fee established
pursuant to a resolution, to bona fide visitors of residents of a
designated residential permit parking area, and exemption parking
permits may be issued, without payment of a fee, to handicapped persons.
H.
Responsibility of permit holder:
(1)
Notwithstanding any provision of this section to the contrary, the
holder of a residential parking permit shall be permitted to stand
or park a motor vehicle operated by him in any designated residential
parking area during those times when parking of motor vehicles is
permitted in that area. While a vehicle for which a residential parking
permit has been issued is so parked, that permit shall be displayed
so as to be clearly visible through the windshield of the vehicle.
A residential parking permit shall not guarantee or reserve to the
holder a parking space within a designated residential permit parking
area.
(2)
A residential parking permit shall not authorize its holder to stand
or park a motor vehicle in any place where or at any time when stopping,
standing or parking of motor vehicles is prohibited or set aside for
other specified types of vehicles, nor shall the permit exempt its
holder from the observance of any traffic or parking regulation other
than residential permit parking regulation or restriction.
(3)
No person other than the permit holder whose name appears on the
permit shall use a residential parking permit or display it on a vehicle
operated; any such use or display by a person other than the permit
holder shall constitute a violation of this section by the permit
holder and by the person who so used or displayed the parking permit.
(4)
It shall constitute a violation of this section for any person falsely
to represent himself as eligible for a residential parking permit
or to furnish false information in an application to the Chief of
Police in order to obtain a residential parking permit.
(a)
Revocation of permits. The Chief of Police shall have authority
to revoke the residential parking permit of any permit holder found
to be in violation of any provision of this section. Upon written
notification to him of the revocation, the permit holder shall surrender
the permit to the Chief of Police. Failure to do so, when so requested,
shall constitute a violation of this section. Provided: any person
receiving such a notice may, within 10 days after the date of the
notice, appeal to Borough Council for a hearing on the revocation,
and the decision of Borough Council shall be final.

A.
Any person who violates any provision of § 234-32, 234-33, 234-34, 234-35.1, 234-35.2, 234-36, 234-37, 234-39, 234-40, or 234-41 shall, upon conviction, be sentenced to pay a fine of not more than $20 plus costs, provided it shall be the duty of Borough police officers and parking enforcement personnel to report all violations of any provision of this article (except § 234-35) to the appropriate official, indicating in each case: the section violated, the license number of the vehicle involved in the violation, the location of the violation, and any other facts that may be pertinent to the circumstances of the violation. The police officer or other personnel making the report shall attach to or place upon every vehicle involved in a violation a notice stating that the vehicle has been parked in violation of this article. The notice shall set forth instructions to the owner or operator of the vehicle that upon reporting to the office of the Chief of Police within 10 days and the presentation of payment in the amount of $15, the owner or operator will be relieved of prosecution and from the payment of a fine in the amount of $20, plus costs, referenced in the first sentence of this section.

B.
Further, any person who violates any provision of § 234-35, shall, upon conviction, be sentenced to pay a fine of not more than $600 and costs, with a minimum fine of $25 and, in default of payment of the fine and costs, to imprisonment for not more than 30 days.
C.
Pursuant to Section 6109 of the Pennsylvania Vehicle Code [75 P.S. § 6109(22)], any vehicle found to be in violation of the provisions of § 234-35 of this article above indicated may, upon the direction of any police officer of the Borough, be towed to and impounded at a location as determined by said police officer, at the owner's sole cost and expense.
