Except as provided in § 60-3D(3), any person found to be in violation or found to have failed to comply with any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine of not less than $100 and not more that $2,000; or imprisoned for a term not to exceed 90 days, or both, in the county jail. Each day of such violation or failure to comply shall constitute a separate offense and, therefore, is not subject to merger either for the purposes of the violation or imposition of fines and penalties.
A.
Violation of this chapter shall be prosecuted in the Municipal Court
of Elk Township upon the filing of a complaint and summons or warrant.
The complaint shall specify which provision of this chapter or of
any statute dealing with the subject matter of this chapter is alleged
to have been violated by the defendant(s).
B.
Any officer authorized by law to serve and execute any process may
serve and execute process in the court in which proceedings are brought
hereunder for violation of this chapter or of the statutes dealing
with the subject matter of this chapter.
C.
The Township Official or the Animal Control Officer appointed hereunder
or any agent, servant or employee of such Animal Control Officer is
specifically constituted a property party to file a complaint in the
Municipal Court in the name of the Township of Elk and serve and execute
any process in conjunction therewith relating to any alleged violation
of this chapter or of the statutes dealing with the subject matter
of this chapter.
