An environmental advisory council is hereby established pursuant
to the provisions of 53 Pa. C.S.A. § 2321 et seq., which
shall be known as the "Doylestown Borough Environmental Advisory Council"
and hereinafter referred to as the "Environmental Advisory Council"
(EAC).

The purpose of the Environmental Advisory Council (EAC) shall
be to advise Borough Council and other agencies, commissions and boards
of the Borough of Doylestown on matters dealing with protection, conservation,
management, promotion and use of natural resources, including air,
land and water resources located within the territorial limits of
the Borough of Doylestown.

1. The Environmental Advisory Council (EAC) shall consist of seven members
who shall be appointed by Borough Council. Initially, Borough Council
shall appoint three members to serve for a term of three years, two
members to serve for a term of two years, and two member to serve
for a term of one year. At the expiration of the said initial terms
and thereafter, Borough Council shall appoint, or reappoint as the
case may be, members to serve for a term of three years. Borough Council
shall fill all vacancies in the Environmental Advisory Council (EAC)
by appointment for the unexpired term.
2. Borough Council shall designate the chairperson of the Environmental
Advisory Council (EAC). Whenever possible, one member shall also be
a member of the Doylestown Borough Planning Commission.
3. Members of the Environmental Advisory Council (EAC) shall serve without
compensation.
4. Only appointed members of the Environmental Advisory Council (EAC)
shall have the right to cast a vote during its proceedings.

1. The Environmental Advisory Council (EAC) shall initially meet within
30 days following the appointment of its members by Borough Council
at which time it shall organize and elect from its own membership
a Vice Chairperson and a Secretary, who shall serve at the pleasure
of the Environmental Advisory Council (EAC). A majority of the membership
of the Environmental Advisory Council (EAC) then in office shall constitute
a quorum.
2. The Environmental Advisory Council (EAC) may adopt such rules, regulations
and bylaw, consistent with this Subpart, as it deems necessary for
efficient administration and operation and for the proper conduct
of meetings.
3. The Environmental Advisory Council (EAC) shall keep records of its
meetings and activities and shall make an annual report to Borough
Council which report shall be made known and available. In addition
to the foregoing, the Environmental Advisory Council (EAC) shall keep
minutes of each meeting and forward a copy of same to Borough Council
promptly upon approval and acceptance of same.

The Environmental Advisory Council (EAC) shall, on or before
September 30 of each year, submit a proposed budget for the following
calendar year to Borough Council for its consideration and approval.
All expenditures made on behalf of the Environmental Advisory Council
(EAC) shall be in accordance with the approved budget.

The Borough may fund all or any part of the operations and activities
of the Environmental Advisory Council (EAC) from the General Fund
of the Borough, as the Borough may determine, including the provision
of paid staff to assist the Environmental Advisory Council in carrying
out its purposes. It is the intention of this Subpart that the Environmental
Advisory Council (EAC) may engage in fund-raising activities which
are approved by Borough Council in order to raise funds to partially
or totally finance its operations and activities.

All funds raised, generated, or otherwise received by the Environmental
Advisory Council (EAC), from any source whatsoever, shall be promptly
transferred to the Borough and all such funds shall be deposited by
the Borough Treasurer in a separate account to be known as the "Doylestown
Borough EAC Account." The funds in said Account shall be used solely
for the purposes of the Environmental Advisory Council and shall be
disbursed by the Borough Treasurer. All disbursements from the said
Account shall first be approved by Borough Council in the same manner
as other funds of the Borough are disbursed.

The provisions of this Subpart are declared to be severable.
If any provision of this Subpart is declared to be invalid or unconstitutional
by a court of competent jurisdiction, such determination shall have
no effect on the remaining provisions of this Subpart.
