No person shall have on or about his person, possess, carry or transport liquor, wine, beer, or other alcoholic beverages in open containers in or upon any public sidewalk, street, parking lot, shopping center, public park, playground, public grounds or any other public place in the Borough of Doylestown. Further, no person shall drink or consume liquor, wine, beer, or other alcoholic beverages in or upon any public sidewalk, street, parking lot, shopping center, public park, playground, public ground or any other public place in the Borough of Doylestown, except as authorized pursuant to a permit issued pursuant to Chapter 13, Part 10 (Sidewalk Dining) or Part 13 (Platform Dining), or when specifically authorized by Borough Council. In the case of Borough-sponsored pedestrian zones, this exception to the otherwise complete prohibition against open containers above is limited to extensions of existing uses involving the sale, service, or consumption of alcohol as approved by Borough staff and subject to the establishment owner or operator securing the required PLCB extension.

As used in this Part, the following terms shall have the meanings indicated:
ON OR ABOUT THE PERSON
The location of any container, bottle or can containing any alcoholic beverage which is nearby, close at hand, convenient of access, and within such distance of the party so having it as that such party could without materially changing his position get his hand on it.
OPEN
The condition of a container whose cap, cork, or other top has been removed or the condition of a can which has been punctured or pulled open so as to break its seal.
PERSON
Shall include an individual, firm, association, organization, partnership, trust, company, corporation or any other similar entity.

POSSESSION
The exercising of conscious dominion over any container, bottle or can containing an alcoholic beverage.

Any person, firm or corporation who shall violate any provision of this Part 1 shall, upon conviction thereof, be sentenced to pay a fine of not more than $500; and/or to imprisonment for a term not to exceed 90 days.

All resolutions, ordinances or parts of ordinances heretofore enacted inconsistent herewith are hereby repealed insofar as such inconsistency may exist.
