A.
Any drain or conveyance, whether on the surface or underground, that
allows any nonstormwater discharge including sewage, process wastewater,
and wash water to enter the municipality's separate storm sewer system
or waters of the commonwealth is prohibited.
B.
Any drain or conveyance connected from a commercial or industrial
land use to the municipality's separate storm sewer system, which
has not been documented in plans, maps or equivalent records, and
approved by the municipality, is prohibited.
C.
No person shall allow or cause to allow discharges into the municipality's separate storm sewer system or into surface waters of the commonwealth which are not composed entirely of stormwater, except those in Subsection D below, and discharges allowed under a state or federal permit.
D.
The following discharges are authorized unless they are determined
to be significant contributors to pollution to the waters of the commonwealth:
(1)
Potable water sources, including dechlorinated waterline and fire
hydrant flushings.
(2)
Irrigation drainage.
(3)
Air-conditioning condensate.
(4)
Springs.
(5)
Water from crawl space pumps.
(6)
Pavement wash waters where spills or leaks of toxic or hazardous
materials have not occurred (unless all spill material has been removed)
and where detergents are not used.
(7)
Discharges from fire-fighting activities.
(8)
Flows from riparian habitats and wetlands.
(9)
Uncontaminated water from foundations or from footing drains.
(10)
Lawn watering.
(11)
Dechlorinated swimming pool discharges.
(12)
Uncontaminated groundwater.
(13)
Water from individual residential car washing.
(14)
Routine external building washdown (which does not use detergents
or other compounds).
E.
In the event that the municipality or PADEP determines that any of the discharges identified in Subsection D is a significant contributor to pollution of the waters of the commonwealth, the responsible person(s) shall be notified to cease the discharge. Upon notice provided by the municipality or PADEP, the discharger will have a reasonable time, as determined by the municipality or PADEP, to cease the discharge, consistent with the degree of pollution caused by the discharge.
F.
Nothing in this section shall affect a discharger's responsibilities
under commonwealth law.
Roof drains and sump pumps shall discharge to infiltration areas,
vegetative BMPs, or pervious areas to the maximum extent practicable.
A.
No person shall modify, remove, fill, landscape, or alter any existing
stormwater BMP, facilities, areas or structures, unless it is part
of an approved maintenance program, without the written approval of
the municipality.
B.
No person shall place any structure, fill, landscaping, or vegetation
into a stormwater BMP, facilities, areas, structures, or within a
drainage easement which would limit or alter the functioning of the
BMP, without the written approval of the municipality.
