§ 440-23 Presumption.

As to any vehicle, whether motorized or other, parked or parking in violation of this chapter, the owner or lessee of the vehicle shall be held responsible for any violation and shall be liable for any and all costs, fines, fees, and expenses stemming from such violations. In the event that the driver of the vehicle is someone other than the owner or lessee and can be so determined, the City may also hold the driver responsible for any and all costs, fines, fees, and expenses.

§ 440-24 Vehicles to be parked within marked spaces.

Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.

§ 440-24.1 Vehicles parked facing against direction of traffic.

No owner of a vehicle shall allow the vehicle to stop, stand, or park in a roadway other than parallel with the edge of the roadway, headed in the direction of traffic, and with the curb-side wheels of the vehicle within six inches of the curb or edge of the roadway.

§ 440-25 Parking prohibited at all times in certain locations.

A. No person shall park a vehicle in violation of the Pennsylvania Motor Vehicle Code § 3353.a including, but not limited to, parking the appropriate distance from fire hydrants and pedestrian crosswalks as determined by Motor Vehicle Code.

B. Parking shall be prohibited at all times in the following locations:

§ 440-27 Parking of trucks, buses and certain other vehicles prohibited in certain locations.

It shall be unlawful for any person to park or to allow to remain parked on any of the following streets or parts of streets any vehicle other than a passenger car (which shall not include any bus, motor home or passenger car attached to a trailer of any kind):

§ 440-29 Special-purpose parking zones established; parking otherwise prohibited.

§ 440-30 Parking prohibited between curb and sidewalk except along designated streets.

Parking shall be prohibited at all times between the curb and the sidewalk, except along the portions of streets designated as follows:

§ 440-33 Standing or parking on roadway for loading or unloading.

It shall be unlawful for any person to stop, stand, or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted on the following named streets on Monday through Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary for the loading or unloading:

§ 440-34 Angle parking required on portions of certain streets.

A. Only angle parking shall be permitted on the following portions of streets:

B. On all streets where angle parking is required, every vehicle parked at the angle shall be parked with its front nearest the curb.

§ 440-35 Regulating parking spaces for persons with a disability and disabled veterans.

The City Manager may provide, at convenient and suitable locations, on-street spaces for the benefit of individuals with disabilities and permanently disabled veterans through use of a publically available internal policy guided by this section. It shall be unlawful and a violation of this article for any person to park in any such reserved parking space any vehicle unless that vehicle bears or displays either a person with a disability registration plate or parking placard.

A. All on-street and off-street parking designated for persons with a disability or disabled veterans in the areas under the jurisdiction of the City shall be located, designed and signed to be in compliance with current requirements and accessible designs of the American with Disabilities Act, directives of the Pennsylvania Department of Transportation or, when not available, the U.S. Department of Transportation.

B. Disability or disabled veterans parking program for residential and commercial property owners:

(1) There are hereby created in the City of Warren specific parking spaces which will be available only for parking motor vehicles bearing a "handicapped" (HC), "person with a disability" (PD), or "severely disabled veteran" (SDV) vehicle registration plate or which displays an HC, PD or SDV parking placard, as such are prescribed by the Pennsylvania Motor Vehicle Code, and which are used for transportation of a person with a disability or severely disabled veteran who is the applicant or resident of the applicant's household. The location of said parking spaces shall be determined by the City Manager or designee, based on information provided in the application. In such cases, parking time shall not be limited unless other parking restrictions already exist. Such license plate must be properly affixed to the vehicle or such placard must be readily visible from outside of the vehicle.

(2) The City Manager or designee may, from time to time, when off-street parking is not available or it is determined that the off-street parking which is available is unacceptable, designate on-street parking spaces for persons with a disability and disabled veterans as near as practical to the residence of a disabled person or severely disabled veteran or applicant commercial enterprise upon the written application of any residential or commercial property owner or their agent and payment to the City of the required fee, as set forth in the City's fee resolution in effect at the time. The application shall set forth the make, model, year and vehicle identification number (VIN) of the applicant's vehicle and placard or license number. Following erection of appropriate signage in accordance with the Motor Vehicle Code, the designated space may only be used by persons who are in fact disabled persons or who are severely disabled veterans, in compliance with Subsection B(1). Notwithstanding the foregoing, such spaces shall not be solely for the person for whom the request was made.

(3) The City shall be under no obligation to create such spaces, but may do so in its sole discretion, considering all relevant circumstances, including, but not limited to, the availability of the space directly in front of or adjacent to the applicant's residence.

(4) Any designated HC, PD or SDV parking spaces which are approved shall become effective upon payment of the required fee and erection of appropriate signage in accordance with the Motor Vehicle Code.

(5) It is the duty of the permit holder of a parking space designated for persons with a disability and disabled veterans to notify the City of any change of status or relocation to another residence in the City. The permit and the signage may be transferred to a new location within the City upon application to and approval by the City Manager or designee. A relocation fee as set forth in the City's fee resolution in effect at the time shall be charged for the transfer of the HC, PD or SDV parking space.

(6) Any individual who falsifies or who provides false information for the purpose of obtaining a parking space designated for a person with a disability or disabled veteran shall be punishable by a fine of not more than $600, including all costs and fees associated therewith, including reasonable attorney's fees.

(7) In addition to the penalty provisions set forth above, the owner of any vehicle found to be in violation of this Section and/or the relevant provisions of the Motor Vehicle Code shall be sentenced to pay a fine in accordance with the provisions of the Pennsylvania Motor Vehicle Code and 14.B of this Section and shall be subject to having the vehicle towed at the owner's sole cost and expense.

§ 440-36 Parking in parks and recreational areas.

A. No motor vehicle or trailer of any kind shall be permitted to be parked within the parking areas or roadways of any park except during periods of time that the driver thereof is using the park facilities, and no parking shall be permitted for any reason between the hours of 9:30 p.m. to 7:30 a.m., except that the Special Events Committee may issue a written permit for parking required by a person participating in a special event at a park for a period of time no longer than the duration of the event.

B. Parking in all parking spaces immediately adjacent to the City-owned recreational property known as Breeze Point Landing and zoned as P Preservation shall be limited to a maximum of two hours per weekday (Monday through Friday) between the hours of 8:00 a.m. and 5:00 p.m. Parking is permitted within these spaces at any time from 5:00 p.m. until 8:00 a.m. on the following weekday.

§ 440-37 Report and notice of violation.

A. The police officer or other person making the report shall place on or attach to the vehicle, where possible, a notice to the owner thereof that such vehicle was parked in violation of a provision of this section and to report:

(1) The state, provincial or other license number of such vehicle;

(2) The location and nature of the parking violation;

(3) The time at which such vehicle noted to be parked in violation of the provision of this section; and

(4) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation.

B. Every owner shall, within five business days from when the notice was attached to the vehicle, pay to the City of Warren, as a fine and in full satisfaction of the violation, the sum of:

C. The failure of the owner to make payment to the City of Warren within a five-business-day period shall render the owner subject to the penalties hereinafter provided for violation of the provisions of this section. The City Manager or designee shall have sole discretion to waive fines and determination will be made on individual merit.

D. If the owner shall, in fact, make payment after the five-business-day period but before 30 days has elapsed from the date of the violation or before the filing of a complaint with the District Justice on account of such violation, the following payments shall be accepted in full satisfaction of violations of this section:

§ 440-38 Violations and penalties.

Any person who shall violate any provision of this section shall, for each and every violation, upon conviction thereof, be sentenced to pay the fine detailed in § 440-37D and costs of prosecution including but not limited to filing fees, attorney fees, and compensation for applicable witness' court time. Any person violating the unauthorized use of a parking space designated for persons with a disability and disabled veterans shall, for each and every violation, upon conviction thereof, be sentenced to pay the maximum fine authorized by the Pennsylvania Motor Vehicle Code § 3354 for the violation plus the costs of prosecution including but not limited to filing fees, attorney fees, and compensation for applicable witness' court time.
