Definitions.
As used in this chapter, these words and terms shall have the following
meanings:
ADMINISTRATIVE
The function of carrying out the policies, ordinances, or
mandates of Council.
ADMINISTRATIVE MANUAL
A document specifying the operating procedures which control
the performance of municipal departments, including, but not necessarily
limited to, descriptions of the duties and responsibilities of subordinate
units, rules and regulations and setting forth requirements for appropriate
administrative procedures, records and reports.
ADVISORY
The function of gathering facts and making recommendations
to Council or to any other body designated by Council.
BOARD
A body established under the provisions of the law or by
a valid ordinance of the municipality, on a permanent basis and for
indefinite duration, to perform those functions of a judicial or quasi-judicial
nature that are specified in the ordinance creating the board or the
law governing it, and to be composed of three or more individuals
appointed by Council for definite terms of office. Where a body falling
within this definition of "board" shall, by law, be required to be
designated as a "commission," that fact shall be clearly stated in
the ordinance creating or governing that "commission," and that ordinance
shall specify that the "commission" shall perform the functions of
a "board" rather than a "commission."
CHARTER
The Home Rule Charter of the City of Warren, Pennsylvania,
as approved by the voters of the City on May 20, 1975, and as may
be amended from time to time.
CITY
The City of Warren, Pennsylvania.
COMMISSION
A body established under the provisions of the law or by
a valid ordinance of the municipality, on a permanent basis and for
indefinite duration, to perform those functions of an advisory or
administrative nature that are specified in the ordinance creating
the commission or in the law governing it, and to be composed of not
less than three nor more than seven individuals appointed by Council
for definite terms of office. Where a body falling within this definition
of "commission" shall, by law, be required to be designated as a "board,"
that fact shall be clearly stated in the ordinance creating or governing
that "board," and that ordinance shall specify that the "board" shall
have only the authority of a "commission," as defined in this subsection.
COUNCIL
The Council, as provided for in Article
V of the Charter.
JUDICIAL
The function of hearing and deciding cases or controversies
arising from the application of ordinances, regulations or laws.
LAW
Applicable provisions of the Constitution and any statutes
of the Commonwealth of Pennsylvania and of the United States of America.
MANAGER
The Municipal Manager, as provided for in Article IX of the
Charter.
ORDINANCE
Ordinances of the municipality, including this Administrative
Code.
PERSON
A natural person, partnership, association, firm, or other
entity.
