The purpose of Residential Zone R-4 shall be to create a zoning district for multifamily dwellings at a maximum density of 12 units per acre for all developments except housing for the elderly as permitted by § 365-44.
Within this zone, no lot or building shall be used and no building shall be erected or altered to be used in whole or in part unless it complies with the schedule of Article III and the following regulations.
Home occupations. Persons employed by any company, business, agency or government who are part of a program permitting employees to work from their homes are not subject to the requirements of this section, providing the "home office" is restricted to computer and telephone communication, no customers or clients come to the home, and no merchandise is stored in or sold from the home.

Permitted home occupations are:
Single business owner.
Seamstress, tailor or embroidery.
Salesperson, provided that products are not stored on site.
Tutor in academic studies.
Manufacturers' representative, provided that no products are stored on site.
General and subcontractors in the building trades, providing no equipment, materials or supplies are stored on site or on the street.
In addition to other requirements of this section, home occupations shall meet all of the following standards and conditions:
There shall be no display of advertising or signage on the property, such as freestanding, monument or facade signage, identifying the home occupation or business.
No more than one employee may work at the dwelling, other than the owner of the dwelling, provided that there is sufficient off-street parking for that employee.
The home occupation shall be conducted entirely within 15% of the total gross habitable floor area of the principal building, excluding space used for a private garage or basement. Vehicular and pedestrian circulation, as well as parking in the vicinity of the home occupation, shall not be impaired.
No mechanical equipment or other merchandise shall be stored or sold on the premises.
In the case of contractors, no employees shall leave their vehicles on site to use a company vehicle during working hours. No more than one commercial vehicle, registered in the name of the property/business owner, may be parked at the residence.
The home occupational use shall not alter the residential aspect of the neighborhood.
No activity shall be visible from a property line or street.
There shall be no change in the exterior residential appearance of the dwelling.
Mercantile license is required.
The following uses shall be permitted in Residential Zone R-4:
Townhouses and row houses.
Housing for the elderly in garden apartment, townhouse or mid-rise apartment buildings, subject to the following standards:
All units in the development shall be reserved by deed or covenant for permanent residents of at least 62 years of age, except that the spouse or one immediate relative, live-in domestic, companion or nurse aged 18 or older may reside in the unit. In no event shall more than two permanent residents reside in any one residential unit designated as housing for the elderly. The deed or covenant reserving the unit as housing for the elderly shall be subject to the review and approval of the Borough Solicitor.
The residential density in developments of housing for the elderly may be increased to a maximum of 20 units per acre.
The maximum height of a mid-rise apartment constructed as housing for the elderly shall be 12 stories.
The minimum unit floor areas in Residential Zone R-4 may be reduced in accordance with the following schedule for units which qualify as housing for the elderly:
Day-care centers, community centers and recreation facilities designed and maintained to meet the social service needs of the residents within the development.
Multifamily residential developments shall adhere to the following standards:
There shall be a minimum distance of 25 feet between any group of single-family attached units and any other group of single-family attached units. There shall be a minimum distance of 50 feet between any multifamily structure and any other structure or property line, and a minimum distance of 100 feet plus 10 feet for each story exceeding six stories for any mid-rise structure.
There shall be a minimum setback of 75 feet between any structure and a state, county or municipal street.
All streets, roads, access drives and parking areas shall be paved and provided with curbing in accordance with the Borough's standards and specifications.
Pedestrian walks shall be provided wherever normal pedestrian traffic will occur. Pedestrian walks shall be hard-surfaced in accordance with the Borough's specifications and standards.
All developments shall provide for landscaping, including shade trees, shrubs and lawns. The landscape plan shall be subject to the review and approval of the Joint Land Use Board.

All developments shall provide sufficient illumination of streets, roads, access drives, parking areas, dwelling entrances and pedestrian walks. The site lighting plan shall be subject to the review and approval of the Joint Land Use Board.

Each dwelling unit shall contain a minimum of one bedroom, complete kitchen facilities, interior storage areas, bathroom areas, adequate living space and a minimum habitable floor area in accordance with the following schedule:
All dwelling units shall be soundproofed to a limit of at least 45 decibels.
Within each development, recreation areas for preschool children and school-age children shall be provided. Recreation areas for preschool children shall be fenced. Developments containing four or more acres shall be provided with open areas for active recreation and surfaced areas for court games such as basketball, tennis, handball or volleyball. Developments containing 15 or more acres shall provide open field areas for group games such as softball, soccer or football.
No garage structure apart from such facilities contained within the dwelling structure or underground shall be permitted in multifamily developments.
In any apartment or in any high-rise apartment constructed under this article it shall be required that no more than 25% of the units therein shall include multi-bedroom apartments.

Any construction, alteration, modification or change in the use of a building, structure or lot shall conform to the regulations in the Borough's Construction Code and shall be subject to the review procedures in the Borough's Development Review and Land Use Procedures Ordinance.
