No person, firm or corporation shall hereafter construct, reconstruct, pave, repave, repair, improve or do any work on or upon any portion of a dedicated public right-of-way or on or upon any street, avenue, road, lane or alley shown or indicated upon any map heretofore or hereafter approved by the Township Committee of the Township of Buena Vista and filed with the Clerk of Atlantic County pursuant to the laws of the State of New Jersey heretofore or hereafter in such case made and provided, unless an approval shall be first secured from the Planning Board of the Township of Buena Vista.
A. 
Application procedure.
(1) 
Such approval shall not be issued by the Township Planning Board until such person, firm or corporation has submitted to the Planning Board of the Township of Buena Vista an application containing a plan or plans and grade profiles which shall indicate the proposed grades, provisions for stormwater drainage and the materials to be used in the construction and the proposed method of construction within the terminal points of each street, avenue, road, lane or alley which is proposed to be improved or constructed.

(2) 
Said applicant shall also post with the Planning Board of the Township of Buena Vista a corporate surety bond, cash or certified check in favor of the Township of Buena Vista, subject in all respects, including form and amount, to the approval of the Planning Board and to the approval of the Township Committee, guaranteeing the completion of the work in full compliance with the terms of this article or any other pertinent Township ordinance within the period of one year from the date of the issuance of said permit.
(3) 
The application for said permit shall also include a professional engineer's estimate of the cost of construction for each of said streets or public rights-of-way within the designated terminals.
(4) 
The applicant shall also submit with the application to the Planning Board a plan indicating the existing and proposed elevations of the overall drainage grading pattern of the entire development pertaining to any and all proposed streets or public rights-of-way affected by such application and any later application for a permit relative to any part of said development.
(5) 
All items in said application shall be analyzed by the Township Engineer and shall require his approval or disapproval before the said application is acted upon by the Planning Board of the Township of Buena Vista.
(6) 
The corporate surety bond, cash or certified check which is accepted upon the issuance of said permit will be released and returned upon the completed construction of said streets or public rights-of-way within their designated terminals in full compliance with the terms hereof after verification by the Township Engineer and the Planning Board and the subsequent approval of the Township Committee, as hereinafter provided.
B. 
All applications for the construction, reconstruction, paving, repaving, repairing or improving of any street or public right-of-way shall be made to the Planning Board Secretary and/or Administrator transmitting 15 copies, and such application shall contain the plans, profiles and specifications concerning the proposed construction, reconstruction, paving, repaving, repairing and improving of the street or public right-of-way.

A. 
The width of the cartway or the driveway portion of the proposed street or public right-of-way shall be measured from lot line to lot line and shall not be less than the following:
(1) 
Arterial streets: 80 feet.
(2) 
Collector streets: 60 feet.
(3) 
Minor streets: 50 feet.
(4) 
Marginal access streets: 40 feet.
(5) 
The right-of-way width for internal roads and alleys in multifamily, commercial and industrial developments shall be determined on an individual basis and shall in all cases be of sufficient width and design to safely accommodate the maximum traffic, parking and loading needs and maximum access for fire-fighting equipment.
B. 
The driveway portion or cartway to be used shall have a minimum construction as follows:
(1) 
Road gravel to a compacted depth of six inches and the stipulated width as above provided.
(2) 
The road gravel used in the improvement or construction of said street or public right-of-way shall meet the specifications for road gravel as indicated by the New Jersey State Standard Highway Specifications for road gravel, and all methods for grading, alignment and provisions for stormwater drainage shall be performed in compliance with the New Jersey Highway Specifications for the construction, reconstruction, paving, repaving, repairing or improving of any dedicated public street or right-of-way or any street, avenue, road, lane or alley shown or indicated upon any map heretofore or hereafter approved by the Township Committee of the Township of Buena Vista.
(3) 
No street shall be constructed, reconstructed, paved, repaved, repaired or improved in such manner as shall not provide for the adequate disposal of stormwaters and shall not impound any street waters within the length of the streets so constructed or improved that shall cause a hazard or unsafe condition to the public using the same.
The Planning Board shall act on the application within 90 days after submission to the Municipal Clerk. The person, firm or corporation submitting the application shall be notified of the action of the Planning Board within 90 days of its submission.
If the Planning Board acts favorably on the application and the application is approved by the Township Engineer, as hereinbefore provided, a notation to that effect shall be made on the application and it shall be referred to the governing body for action. The application shall be accompanied by a statement by the Township Engineer that he is in receipt of the application, that he has analyzed the same and that the applicant has complied with the terms and provisions of this article. The governing body shall act within 30 days. Its action shall be noted on the application, signed by the Mayor, and it shall be returned to the applicant.
The enactment and enforcement of this article shall not be construed as an acceptance by the Township of Buena Vista of any road, street or highway indicated on any map heretofore or hereafter approved by the Township of Buena Vista, nor shall the enactment or enforcement of this article in any way obligate the Township of Buena Vista to maintain or exercise jurisdiction over such roads, streets or highways which are indicated upon any map heretofore or hereafter approved by the Township Committee of the Township of Buena Vista and filed with the county recording officer of the County of Atlantic.

Any person, firm or corporation who shall violate any of the provisions of this article shall for each offense be punishable as provided in Chapter 1, General Provisions, § 1-15, and each day's continuance of such violation shall constitute a separate offense.
