A.
The purpose of this chapter is to protect the public health, welfare,
safety, peace and tranquility of the residents and visitors of the
Village of Central Square by regulating the operation and establishments
of tattoo studios and body piercing studios and by prohibiting branding
and scarification within the Village of Central Square.
B.
The Village of Central Square recognizes that the threat of AIDS/HIV
and hepatitis contamination through shared needles and other aspects
of the tattoo and body piercing processes and the high risk of infection
posed by branding and scarification have the potential to negatively
affect the health and safety of the general public. The Village of
Central Square realizes its obligation to protect the health and safety
of its people and hereby regulates such industries.
C.
The Village of Central Square hereby finds and declares the need
to protect its residents and visitors through greater supervision
of tattoo studios and body piercing studios, and by prohibiting branding
and scarification within the Village of Central Square.
D.
Due consideration has been given with respect to making provisions
for suitable locations within a zone that is appropriate for a proper
balance between the regulated activities and existing as well as anticipated
businesses and residences within the municipality in selecting appropriate
locations for the regulated activity as herein provided.
This chapter shall hereafter be known and cited as the "Tattoo,
Body Piercing, Branding, and Scarification Regulations."
As used in this chapter, the following words shall have the
following respective meanings:
Any solution used to retard the growth of bacteria approved
for application to human skin and includes all products labeled accordingly.
Human blood.
Pathogenic microorganisms that are present in human blood
which can cause disease in humans. These pathogens include, but are
not limited to, the following:
The piercing of any part of the body, except the ear or nose
(cartilage piercing).
Any person who performs body piercing to the body of any
other person.
Any premises in which the body piercing specialist conducts
such practice.
The use of heat, cold or any chemical compound to imprint
permanent markings on human skin by any means other than tattooing.
The removal of all visible dust, soil, or any other foreign
material.
Any person under the age of 18 years of age.
The partnership, the corporation, the association, or the
person or group of persons who maintain and control the tattoo/body
piercing studio and who are legally responsible for the operation
of the studio.
The following:
Human body fluids as follows:
Semen.
Vaginal secretions.
Cerebrospinal fluid.
Synovial fluid.
Pleural fluid.
Pericardial fluid.
Peritoneal fluid.
Amniotic fluid.
Saliva in dental procedures.
Any body fluid that is visibly contaminated with blood.
All body fluids where it is difficult or impossible to differentiate
between body fluids.
Any unfixed tissue or organ, other than intact skin, from a
human, living or dead.
HIV-containing cell or tissue cultures, and HIV- or HBV-containing
culture medium or other solutions; and blood, organs, or other tissues
from experimental animals infected with HIV or HBV.
The authorization granted by the Village to operate a tattoo/body
piercing studio.
Clean and free of agents of infection or disease.
Effective antibacterial treatment by a process that provides
sufficient concentration of chemicals for enough time to reduce the
bacteria count including pathogens to a safe level on equipment.
The cutting or tearing of human skin for the purpose of creating
a permanent mark or design on the skin.
Holding an instrument in an autoclave for required length
of time at 15 to 30 pounds pressure at a temperature of 249.8°
F. or 121° C.
A mark on the body of a person made with indelible ink or
pigments injected beneath an outer layer of the skin.
Any person who applies a tattoo to the body of any other
person.
Any premises in which the tattoo artist conducts such practice.
No person, firm, corporation, partnership, or other association
shall operate a body piercing studio or tattoo studio within the Village
of Central Square without first obtaining a license from the Village
of Central Square Board of Trustees as provided herein. No person
shall operate as a body piercing specialist within the Village of
Central Square unless employed by a licensed body piercing studio.
No person shall operate as a tattoo artist within the Village of Central
Square unless employed by a licensed tattoo studio.
A.
Every person desiring to procure a body piercing studio or tattoo
studio license, as herein provided, shall file with the Village Clerk
a written application upon a blank form prepared and furnished by
the Village, together with two two-inch-by-two-inch color photographs
of the applicant taken within 30 days of filing said application form.
B.
Contents. The application shall contain the following information:
(1)
The address of the premises proposed to be licensed.
(2)
Name and residence address of the applicant.
(3)
Date of birth of the applicant.
(4)
Home and work phone numbers.
(5)
Professional training and qualifications of the applicant.
(6)
A copy of the permit required by Article 4-A of the New York State
Public Health Law as well as any other applicable certifications issued
from appropriate state and federal agencies.
(7)
Type of piercing equipment to be used if a body piercing studio license
is sought.
(8)
Method of sterilization or disinfection used by the applicant on
tattoo and/or piercing equipment and customer.
(9)
Whether the applicant has ever been convicted of a felony or misdemeanor
and the details of said conviction(s).
(10)
A diagram, drawn to scale, showing the dimensions of the premises
where such business will be conducted and delineating the interior
floor space specifically designated for the regulated activity.
C.
Insurance. Such application shall be accompanied with proof of general
liability insurance for said establishment in the amount of no less
than $1,000,000 in coverage.
D.
Proof of inoculation. Such application shall be accompanied with
proof that the applicant has completed the Hepatitis B vaccination
series; that antibody testing has revealed that the employee is immune
to Hepatitis B; or that the vaccine is contraindicated for medical
reasons. Contraindication requires a dated and signed physician's
statement specifying the name of the employee and that the vaccine
cannot be given.
E.
License fee and application fee in the form of cash, certified or
bank check payable to the Village of Central Square.
F.
Any additional information that may be required by the Village Planning
Board or Village Board of Trustees.
A body piercing studio or tattoo studio license may not be granted
to an owner or operator convicted of any felony, any offense relating
to fraud of any sort, or any violations of OHSA health regulations.
A.
Upon receiving such application the Village Clerk shall present the
same to the Village of Central Square Planning Board at its next regular
or special Board meeting for their consideration. The Village Planning
Board shall review such application and shall make and file in its
minutes a decision to grant or reject such application within 30 days
of the presentation of such application. The Village Clerk shall immediately
notify such applicant of the Planning Board's decision and, in
the event of a rejection of the application, shall return the license
fee to such applicant.
B.
If the Village Planning Board grants the application, it shall present
the application to the Board of Trustees at its next regular or special
Board meeting for its consideration. The Board of Trustees shall review
such application and shall make and file in its minutes a decision
to grant or reject such application within 30 days of the presentation
of such application. The Village Clerk shall immediately notify such
applicant of the Village Board's decision and, in the event of
a rejection of the application, shall return the license fee to such
applicant.
In the event a license under this chapter is granted at any
time after June 1 of any year, the amount of such license fee shall
be decreased proportionately to the remaining months of the license
year.
Such license, once issued, shall not be transferable and each
new owner or proprietor shall be required to be licensed. A license
shall no longer be valid and shall be returned to the Village when
the studio ceases to operate, has moved to another location, the ownership
changes, or the permit is suspended or revoked.
Every body piercing studio or tattoo studio license issued in
accordance with the provisions of this chapter shall be posted conspicuously
before the commencement of business and maintained on display in a
manner open to public view on the licensed premises.
Such license shall be renewable on June 1 of each year. To secure
renewal of such license, the licensee must make written application
in the form of a request for renewal to the Village Board of Trustees
at least 30 days before the expiration of such license. Such request
shall be accompanied by the payment of the renewal fee in the form
of cash, certified or bank check payable to the Village of Central
Square.
No owner/operator of a body piercing studio or tattoo studio
shall keep more than one house, shop or place for carrying out that
business by virtue of one license, without the written permission
of the Village Board of Trustees.
A.
The operator shall maintain a record, which must be available for
inspection by the Village designated authority, of the names and exact
duties of any employee, artist, or specialist who has been designated
as being responsible for carrying out the rules and policies adopted
by the operator. The following information shall be included: social
security number, DOB, gender, home address, home and work phone numbers,
and ID photos of all artists/specialists.
B.
All body piercing studios and tattoo studios shall maintain a register
of customers in chronological order, to include the following information:
(1)
The client's name and signature, address, proof of age, date
tattooed and/or pierced, design, its location and name of the artist.
(2)
Records of each client shall be prepared prior to the procedure being
performed and shall reflect administered, informed consent.
(3)
A statement by the client attesting that he/she is not under the
influence of alcohol and/or drugs shall be on file.
(4)
A copy of procedures signed by the client advising him/her of proper
subsequent care of the tattoo/piercing shall be maintained on file.
(5)
A statement signed by the customer acknowledging that he/she may
be temporarily prohibited from donating blood under applicable rules
and regulations of the American Red Cross or other regulatory agencies.
C.
The information contained in Subsections B(1) through (5) above shall be recorded in the customer register prior to the commencement of the tattoo or body piercing procedure or any preparation thereof, and such register shall be maintained on premises available for inspection for a period of at least six years.
D.
All tattoo studios and body piercing studios operating in the Village
of Central Square shall obtain a copy of a publication entitled "Guidelines
for the Prevention of Blood Borne Disease During Tattooing" (Guidelines),
distributed by the Bureau of Disease Control of the New York State
Department of Health dated August 1993 (or subsequent editions or
publications of same). Said materials shall be posted in a conspicuous
and public place within the establishment. Failure to comply with
these guidelines shall constitute a violation of this chapter.
E.
All operator/owners must stay in compliance with all applicable Village
regulations regarding signage.
F.
All persons and establishments licensed hereunder shall perform their
activities inside the licensed premises and in compliance with all
provisions of the Land Use Code of the Village of Central Square.
G.
The operator must maintain a file on all employees who perform tattoo/body
piercing procedures, which must be available for inspection by the
Village designated authority, and shall include the following:
A.
Tattoo studios and body piercings studio located within the Village
of Central Square shall not employ any individual under the age of
18.
B.
Persons employed as tattoo artists and body piercing specialists
shall obtain current certification in first aid and proof of attendance
at a blood-borne pathogen training program (or equivalent), given
or approved by the County or State Health Department or by OSHA. Training/courses
provided by professional tattoo or body piercing organizations/associations
or by equipment manufacturers may also be submitted for consideration.
C.
If the tattoo artist or body piercing specialist is currently in
business at the time of application for a permit to operate a tattoo
or body piercing studio, the above certification must be obtained
within 60 days from the date the permit is issued.
D.
Proof shall be provided upon request that all operators, tattoo artists
and body piercing specialists have either completed the Hepatitis
B vaccination series; that antibody testing has revealed that the
employee is immune to Hepatitis B; or that the vaccine is contraindicated
for medical reasons. Contraindication requires a dated and signed
physician's statement specifying the name of the employee and
that the vaccine cannot be given.
E.
Any employee who has a reasonably anticipated risk for skin, eye,
mucous membrane, or peritoneal contact with blood or OPIM shall complete
a blood-borne pathogen training program (or equivalent), given or
approved by the County or State Health Department or by OSHA designed
for those working near blood-borne pathogens.
F.
All employees must be trained in the tattoo or body piercing studios'
policies on the handling of infectious waste.
A.
All body piercing and tattooing shall be performed outside the public
view. Each person and establishment regulated hereunder shall perform
all tattooing and body piercing in a designated enclosed area within
the confines of the establishment licensed hereunder and out of public
view.
B.
All licensees hereunder shall require each person who has received
a tattoo or a body piercing to remain within the licensed premises
for a minimum period of 20 minutes or until all wounds/blood is dried
or clotted, whichever is longer. Each licensee regulated hereunder
shall post in a conspicuous and public place within the establishment
a notice informing the public of such requirement.
C.
Hours of operation will remain consistent with normal commercial
use (no earlier than 8:00 a.m. nor later than 7:00 p.m.)
A.
No tattoo studio or body piercing studio shall be permitted within
500 feet of any school, park or house of worship, and no closer than
500 feet to any other tattoo studio or body piercing studio or adult
entertainment location (e.g., a bar).
B.
To the extent that a tattoo studio or body piercing studio shall
constitute a commercial use, the same shall be permitted only in the
C Commercial Zone and only upon and after site plan review pursuant
to the Land Use Code of the Village of Central Square as a Type I
— use as permitted by a special use permit.
A.
No person or establishment licensed hereunder shall tattoo any person
under the age of 18 years in the Village of Central Square. All licensees
hereunder shall conspicuously post a sign in their business window
stating that tattooing or body piercing of a person under the age
of 18 is prohibited by New York State Penal Law.
B.
No person shall tattoo or body pierce a person who is visibly intoxicated
and/or under the influence of drugs. Operators shall refuse services
to any person who, in the opinion of the operator, is under the influence
of alcohol or drugs.
C.
Tattoo/body piercing artists shall not be under the influence of
alcohol and/or drugs while performing tattoo/body piercing procedures.
D.
Eating, drinking, smoking or applying cosmetics shall not be allowed
in work areas where there is a likelihood of exposure to blood or
OPIM.
E.
Food and drink shall not be kept in areas where there is a reasonably
anticipated risk of exposure to blood or OPIM.
F.
No animals, except for guide dogs accompanying disabled persons,
shall be allowed in the tattoo/body piercing studio.
G.
Branding and/or scarification is prohibited within the Village of
Central Square.
A.
Building sanitation.
(1)
The tattoo or body piercing studio shall be constructed, arranged
and maintained as to provide adequately for the health and safety
of its customers.
(2)
The studio shall be constructed in a manner to allow the customer
receiving the tattoo/body piercing adequate privacy from observers.
The work area shall be separate from the waiting area.
(3)
Tattoo or body piercing studios must have adequate ventilation.
(4)
Walls and ceilings must be painted or covered in a manner which would
allow for easy and effective cleaning.
(5)
Floors should be of a nonabsorbent material that would allow for
effective cleaning by conventional methods.
(6)
A clean and sanitary toilet and handwashing facility shall be made
accessible to customers; however, it shall be separate from the work
area.
(7)
The work area shall be equipped with at least one sink providing
hot and cold running water for the use of the artists for washing
their hands and preparing customers for tattooing/piercing. This area
shall be provided with soap, an antibacterial solution, single-use
towels or air blower, and individual hand brushes for each artist.
(8)
The facility shall be equipped with at least one utility sink, providing
hot and cold running water for use in cleaning reusable receptacles
and the facility.
(9)
The work area shall be provided with adequate lighting.
(10)
The work area shall not be used as a corridor for access to
other rooms.
(11)
The tattoo or body piercing studios shall not be allowed to
operate in automobiles, mobile, transitory or other nonfixed facilities.
Such nonfixed facilities include, but are not limited to, mobile homes,
tents, recreational vehicles, and trailers.
(12)
Tattoo or body piercing studios shall not be allowed in facilities
used for human habitation, any food service establishment, hair salon,
nail salon, retail sales area, hotel room or similar areas.
B.
Furnishing sanitation.
(1)
Furnishings of the tattoo or body piercing studio shall be maintained
in good condition, intact, and functional. Furnishings should be made
of or covered in a material that is easily cleanable and nonabsorbent.
The studio shall be kept clean, neat, and free of litter and rubbish.
(2)
Cabinets for the storage of instruments, dyes, pigments, single-use
articles, carbon, and stencils shall be provided for each tattoo artist
and shall be maintained in a sanitary manner which protects them from
contamination.
(3)
Work tables and chairs shall be provided for each tattoo artist and
body piercing specialist.
(4)
Surfaces of all work tables and chairs shall be constructed of material
which is smooth, nonabsorbent, corrosive-resistant, and easily sanitized.
(5)
Work tables and chairs shall be sanitized with an antibacterial solution
after each application.
C.
Supplies.
(1)
Bulk single-use articles shall be commercially packaged and handled
to protect them from contamination. These articles shall be stored
in an area separate from the toilet facilities.
(2)
All materials applied to the human skin shall be from single-use
containers and shall be disposed of after each use.
D.
Dyes and pigments.
(1)
All dyes and pigments used in tattooing shall be from professional
suppliers specifically providing dyes and/or pigments for the tattooing
of human skin.
(2)
In preparing dyes or pigments to be used by a tattoo artist, only
nontoxic sterile materials shall be used. Single-use or individual
portions of dyes or pigments in clean, sterilized individual containers
or single-use containers shall be used for each patron.
(3)
After tattooing, the remaining unused dye or pigment in the single-use
or individual containers shall be discarded along with the container.
E.
Piercing jewelry.
(1)
Client and piercer should have appropriate size and quality jewelry
chosen before the procedure begins.
(2)
Jewelry to be used in piercing shall consist of an approved material
suitable for permanent surgical implant, such as high-quality surgical
stainless steel (316LVM series), niobium, titanium, platinum or a
dense low-porosity plastic material such as Tygon or PTFE. Copies
of the jewelry manufacturer's documentation, which verify compliance
with standards, must be available for inspection on request of the
local health department. Solid fourteen-karat or higher, white or
yellow nickel-free gold may be used. Purity verification must be available
for inspection at the request of the Village designated authority.
Appropriate jewelry has no nicks, scratches, or irregular surfaces.
(3)
Ear studs or other jewelry designed for earlobe piercing are not
appropriate jewelry for other body parts and must not be used by piercers.
F.
Employee sanitation.
(1)
Prior to the start of the tattoo/body piercing procedure, the artist
or specialist should inspect his/her hands for hangnails, small cuts,
sores, and abrasions. If a cut, sore, or abrasion is detected, a bandage
should be applied for added protection before gloving. Trim fingernails
to ensure that gloves are not punctured.
(2)
Any jewelry near a tattoo site, on the artist or the client, must
be removed prior to the start of the tattoo procedure.
(3)
Before working on each client, the fingernails and hands of the tattoo
artist or body piercing artist shall be thoroughly washed and scrubbed
with warm water and antibacterial soap, using an individual hand brush
that is clean and in good repair. The hands should then be dried by
either an air blower or by single-use towels, prior to beginning work
on each client or done again if the process is interrupted.
(4)
Single-use disposable latex or approved nonlatex examination gloves
shall be worn during the tattooing process. Gloves shall be changed
and properly disposed of each time there is an interruption in the
application of the tattoo, the gloves become torn or punctured, or
whenever their ability to function is compromised.
(5)
Each tattoo artist or body piercing specialist shall wear a clean
outer garment, apron or smock, or use other protective barriers as
needed. These items shall be changed after each client.
(6)
Tattoo artists and body piercing specialists who are experiencing
symptoms of diarrhea, vomiting, fever, rash, or skin infections shall
refrain from tattooing/body piercing activities.
(7)
Adequate numbers of sterile needles and tubes must be on hand for
each artist or specialist for the entire day's operation.
(8)
Only single-use disposable razors shall be used to shave the area
to be tattooed or pierced.
(9)
Smoking is prohibited in the tattoo or body piercing studio.
(10)
The consumption of food or drink is prohibited in the tattoo
or body piercing studio, except in designated areas.
(11)
Universal precautions are to be followed per OSHA standards
and guidelines.
G.
Sterilization.
(1)
An operational sterilizer (autoclave) shall be provided in each tattoo
or body piercing studio.
(2)
Used nondisposable instruments shall be kept in a separate puncture-resistant
container until brush scrubbed in hot water and soap, and then sterilized
by autoclaving.
(3)
The following procedures should be followed during the sterilization
process:
H.
Tattoo preparation.
(1)
Before placing the tattoo design on the client's skin, the artist
shall treat the skin area with an antibacterial solution.
(2)
If an acetate stencil is used by a tattoo artist for transferring
the design to the skin, it shall be thoroughly cleaned and rinsed
in a germicidal solution for at least 20 minutes and then dried with
sterile gauze or dried in the air on a sanitized surface after each
use.
(3)
If a paper stencil is used by a tattoo artist for transferring the
design to the skin, it shall be single use and disposable.
(4)
If the design is drawn directly onto the skin, it shall be applied
with a single-use marking tool only.
I.
Body piercers shall:
(1)
Set up equipment in front of client.
(2)
Open sealed bags containing sterile equipment in front of client,
and discard the bag.
(3)
Disinfect all jewelry contaminated with airborne pathogens (not previously
worn or contaminated) with a nonhazardous hard surface disinfectant
approved by the EPA. All jewelry contaminated or potentially contaminated
with blood-borne pathogens (previously worn by another person) should
be autoclaved, stored in sterile indicator bags, sealed and dated.
(4)
All needles used in piercing shall be sterile, used only on one person,
at one sitting, for a single piercing, and immediately disposed of
in a medical sharps container.
(5)
All forceps, tubes, etc., must be sterile in sealed, dated, sterile
indicator bags. These items are to be used on one person, in one sitting.
After one such use, they must be autoclaved and stored in sterile
indicator bags, sealed and dated.
J.
After tattoo/body piercing application.
(1)
The completed tattoo shall be washed with a single-use towel saturated
with an antibacterial solution.
(2)
After the area has dried, a layer of antibacterial ointment from
a single-use dispenser or applicator shall be applied.
(3)
A bandage or cover shall then be applied to the tattoo using sealed
telfa (nonsticking) pads.
(4)
Verbal and written instructions for the care of the tattoo or piercing
site shall be provided to each client by the operator upon completion
of the procedure. The written instructions shall advise the client
to consult a physician at the first sign of infection and contain
the name, address and phone number of the operator's establishment.
These documents shall be signed and dated by both parties, with a
copy given to the client and the operator retaining the original with
all other required records. The facility shall also post in public
view the name, address and phone number of the local County Health
Department and the procedure for filing a complaint. This information
shall also be included in the establishment instruction packet.
K.
Disinfection of workplace.
(1)
Each tattoo or body piercing studio must be kept clean and sanitary.
The owner must develop and implement a cleaning schedule that includes
appropriate methods of decontamination and tasks or procedures to
be performed. This written schedule must be based on the location
within the studio, the type of surfaces to be cleaned, type of possible
contamination present, and the tasks or procedures to be performed.
(2)
The following procedures should be adhered to:
(a)
Clean and sanitize all equipment and work surfaces with an appropriate
disinfectant after completion of tattoo/body piercing procedures and
at the end of work shift when surfaces have become contaminated since
the last cleaning.
(b)
Remove and replace protective coverings such as plastic wrap
and aluminum foil after each tattoo procedure.
(c)
Inspect and decontaminate, on a daily basis, reusable receptacles
such as bins, pails, and cans that have likelihood for becoming contaminated.
When contamination is visible, clean and decontaminate receptacles
immediately, or as soon as feasible.
All operators are required to develop a written policy for the
handling and disposal of infectious waste.
A.
Needles, razors, or other sharp instruments used during tattoo/body
piercing procedures shall be placed in puncture-resistant, closed
containers immediately after use.
B.
Needles shall not be purposely bent or broken, or otherwise manipulated
by hand.
C.
Containers of sharp waste shall be sent to a facility where they
are either incinerated or otherwise rendered nonhazardous in compliance
with OSHA procedures related to occupational exposure to blood-borne
pathogens.
D.
Contaminated waste which may release liquid blood or body fluids
when compressed or may release dried blood or body fluids when handled
must be placed in an approved "red bag," which is marked with the
international biohazard symbol. It must then be disposed of in compliance
with OSHA procedures related to occupational exposure to blood-borne
pathogens.
E.
Waste containers shall be kept closed when not in use.
F.
Disposable waste shall be handled, stored, and disposed of to minimize
direct exposure of personnel to waste materials.
G.
At least one covered waste receptacle shall be provided in each operator
area and each toilet room. Receptacles in the operator area shall
be emptied daily and solid waste shall be removed from the premises
at least weekly. All refuse containers shall be lidded, cleanable
and kept clean.
Any preexisting tattoo studios or body piercing studios located
within the boundaries of the Village of Central Square must apply
for a license within 60 days from the effective date of this chapter.
A.
The Village of Central Square may, at any time for just cause alleging
any violation of this chapter, and upon reasonable notice to the licensee
with an opportunity to be heard, revoke or limit any license granted
under the provisions of this chapter.
B.
Service of notice. Notice of any hearing and the reason therefor
shall be in writing and may be served by the Village Board, or its
agents, upon the licensee by regular mailing to the address provided
on the license application; or to the address of the licensed premises
or by personal service upon the licensee in accordance with the requirements
of service of process specified in the Civil Practice Laws and Rules.
C.
Effect of revocation. Whenever any license shall be revoked, no refund
of any unearned portion therefor shall be made, and no license shall
be granted to conduct such business to any person whose license has
been revoked within a period of one year from the date of revocation.
The Code Enforcement Officer of the Village of Central Square
and the Village Board of the Village of Central Square in its capacity
as a Village Board of Health shall be the primary enforcement agents
of this chapter.
A.
A violation of this chapter is hereby declared to be an offense,
punishable by a fine not exceeding $350 or imprisonment for a period
not to exceed six months, or both for conviction of a first offense.
B.
For conviction of a second offense, both of which were committed
within a period of five years, punishable by a fine not less than
$350 nor more than $700 or imprisonment for a period not to exceed
six months, or both.
C.
Upon conviction for a third or subsequent offense, all of which were
committed within a period of five years, punishable by a fine not
less than $700 nor more than $1,000 or imprisonment for a period not
to exceed six months, or both.
D.
In addition to fine and imprisonment, enforcement shall include all
civil remedies including those provided by Village Law § 20-2006.
Each week during any portion of which any violation of the chapter
is committed, permitted or continued shall constitute a separate offense.
