This article is adopted and enacted for the following purposes:
A. 
To protect and provide for the public health, safety and general welfare of the citizens of the Township.
B. 
To protect the surface and subsurface waters within the Township from degradation and pollution.
A. 
For all grinder pumps that are owned by the Township, the Township shall provide for their repair and replacement as required by the normal operations of the grinder pump. Such repair and replacement shall be made at no cost to the property owner.
B. 
Unless prior written authorization is obtained by the Township to discharge other materials into the sanitary sewer system, the following materials only may be discharged into the sanitary sewer system:
(1) 
Human waste and toilet paper;
(2) 
Grey water from showers, sinks, tubs and dishwashers;
(3) 
Conventional food wastes, not including grease, as processed through an in-sink garbage disposal unit; and
(4) 
Laundry washing machine discharge.
C. 
All materials discharged into the sanitary sewer system not included in Subsection B above are deemed "unauthorized" materials. Unauthorized materials include, but are not limited to, flushable wipes, diapers, feminine products, plastics, latex and grease.
D. 
In the event a grinder pump must be repaired or replaced due to the discharge of unauthorized materials and/or as the result of the misuse, negligence or intentional acts of the property owner, the Township shall provide for the required repair or replacement, and the property owner shall reimburse the Township for all labor, material and contracted service costs incurred by the Township, plus a ten-percent administration charge.
E. 
Should a property owner refuse to reimburse the Township for all labor, material, contracted service costs and administrative charges incurred in the repair or replacement of a grinder pump, the Township may file a lien against the affected property for these expenses, plus attorney's fees and all other fees, costs and expenses incurred by the Township in its efforts to collect this debt, or the Township may bring suit against the property owner for the collection of this debt.
F. 
It is unlawful to connect sump pumps, downspouts, and water softener backwashes to the sanitary sewer system.
G. 
Each property owner shall immediately cease discharges into the sanitary sewer system if the grinder pump becomes inoperable.
H. 
The property owner shall indemnify and hold the Township, its officers, agents, employees and representatives free and harmless from any liability or responsibility for all injury, loss or damage that may result directly or indirectly from the installation, connection, repair or replacement of the grinder pump.
Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense.
