The Town Board of the Town of Martinsburg, pursuant to the authority
granted it under § 1660(a)(10) of the Vehicle and Traffic
Law of the State of New York and §§ 10 and 20 of the
Municipal Home Rule Law of the State of New York, hereby enacts as
follows.
No vehicles in excess of 10,000 pounds shall be permitted on
Bealuk Road, except for local delivery and pick up.
The Highway Superintendent of the Town of Martinsburg shall
post and maintain signs sufficient to notify drivers of vehicles in
excess of 10,000 pounds that they are not permitted on Bealuk Road.
Any person found to have violated any of terms of this article
shall be guilty of a violation which shall be punishable by a fine
not to exceed $250 or imprisonment for a term not to exceed 15 days
or both.

From November 1 until May 1 of each year, there shall be no
parking on the following portions of Town Roads:

The Town Highway Superintendent is hereby directed to post appropriate
signage notifying the public of no parking in these areas provided
that the signs may be removed at the discretion of the Highway Superintendent
after May 1 as long as they are put back up by November 1 of each
year.
Any person failing to comply with the direction of this article
shall be guilty of a violation and shall be punishable by a fine of
not less than $25 nor more than $100 for a first violation; by a fine
of not less than $50 nor more than $200 for a second violation within
a one-year period; and by a fine of not less than $100 nor more than
$250 for a third or subsequent violation within a one-year period.
Further, if in the discretion of the Highway Superintendent, immediate
removal of the vehicle is necessary to preserve public safety, the
vehicle may be towed by the Town at the owner's expense.
The provisions of this article may be enforced by issuance of
an appearance ticket by any law enforcement official or the Town of
Martinsburg Highway Superintendent.
