The Town Board of the Town of Martinsburg does hereby enact
this chapter for the purpose of promoting the health, safety, morals
and the general welfare of the community. This chapter shall be known
as "the mobile home ordinance of the town of Martinsburg."
As used in this chapter, the following terms shall have the
meanings indicated:
An open space extending fully along the back line of a lot
or a parcel of land and between the side lines and between the back
line of such lot and the back of the structure thereon.
Any form of housing, adaptable to motivation, either propelled
by its own power or the power of another vehicle to which it may be
attached, which is used or capable of being used as sleeping or living
quarters and which is not more than eight feet in width nor more than
30 feet in length.
The person duly appointed and designated as such by the Town
Board of the Town of Martinsburg.
An open space upon a lot or land extending fully along the
front of such lot line and between the side lines and between the
front line of the lot and front line of the structure thereon.
Shall mean the same as "mobile home".
A form of housing, adaptable to motivation, either propelled
by its own power or the power of another vehicle to which it may be
attached, which is used, designed for use or capable of being used
as sleeping or living quarters. Any addition to such mobile home shall,
for the purpose of this chapter, be deemed to be part of such mobile
home.
Any lot, piece or parcel of land where three or more mobile
homes designed for use or capable of being used as living or sleeping
quarters are parked or located.
The lot or space in any mobile home park which shall be assigned
to or used and occupied by any one mobile home.
An open space between a structure and a side line of a lot
or land upon which the structure is located.
A mobile home or any addition thereto or enlargement thereof.
Any lot, piece or parcel of land not municipally owned whereon
two or more camp trailers are parked or located or for which use said
premises are held open to the public for two or more such units.
A.
No person, firm or corporation being the owner or occupant of any
land or premises within the Town of Martinsburg shall use or permit
the use of such land or premises as a mobile home park or trailer
park without obtaining a permit therefor as herein provided.
B.
No person, firm or corporation being the owner of or occupant of
any land or premises within the Town of Martinsburg shall use or permit
the use of such land as a mobile home park or trailer park contrary
to the provision of Part 7 of the New York State Sanitary Code, and
a violation of such Sanitary Code shall be a violation of this chapter.
