A. 
Application for permit. The application for a mobile home park permit shall be in writing and signed by the applicant. It shall state:
(1) 
The name and address of the applicant;
(2) 
The name and address of each partner or other party having a financial interest in such mobile home park;
(3) 
If the applicant is a corporation, the name and address of each officer and director;
(4) 
A complete legal description of the premises upon which the proposed mobile home park is to be located;
(5) 
The name and address of the owner or owners of such premises;
(6) 
The number of mobile homes units to be accommodated in the proposed mobile home park.
B. 
Each application shall be accompanied by detailed plans and specifications having a scale of at least one inch equals 20 feet and representing ground contour lines at two-foot intervals, prepared and certified by a registered architect or licensed professional engineer or a licensed surveyor showing the boundaries of the park, the layout of park units, the location of streets, the location of toilet facilities, lavatories, showers and other bathing facilities, the location of water service, fire hydrants, electrical power, gas, sewage lines or other services to be provided. If the applicant is not the owner of the premises, the application shall also be accompanied by an original or photostatic copy of the lease of the premises and a written statement signed by all of the owners of the property consenting that the premises be used for the purpose of a mobile home park.
C. 
If required by the Town Board of the Town of Martinsburg, such applicant shall submit proof that the applicant has complied with all the pertinent rules and regulations of the New York State Department of Health and of the Sanitary Code of the State of New York.
D. 
If the application is approved by the Town Board of the Town of Martinsburg, the Town Clerk, upon receipt of the fee herein provided, shall issue a permit to become effective from the date thereof and to continue in force for the terms specified therein, but in no event longer than through the 31st day of December next succeeding for the use of the premises therein specified as a mobile home park, which permit shall specify the number of park units which may be used in said park. Such permit shall not be transferable nor assignable.
E. 
Fees. There shall be due and payable during the continuance of a permit issued pursuant to this chapter a fee computed and determined at the rate of $25 per year for each park unit based upon the maximum number of park units as shown in the permit issued pursuant to this chapter.
F. 
In addition to the fee provided for hereinabove, each applicant for a new mobile home park permit, or for a permit to construct additional mobile home spaces, shall at the time of filing his application pay to the Town Clerk an inspection fee computed at the rate of $15 per park unit based upon the maximum number of proposed park units as shown in the application for permit or the maximum number of additional park units if application is made for additional mobile home space.

A. 
Drainage and grading. All lands used as a mobile home park shall be well drained, of ample size and free from heavy or dense growth of brush or weeds. The land shall be properly graded to insure proper drainage during and following a rainfall and shall at all times be so drained as to be free from stagnant pools of water. The sufficiency of drainage and grading shall be subject to the approval of the Town of Martinsburg.
B. 
Mobile home park plan. Each mobile home park constructed, altered or expanded after the effective date of this chapter shall be subdivided and marked off into lots or park units numbered consecutively, the number being conspicuously posted on each mobile home lot and such number to correspond to the same number assigned to such mobile home lot as shown upon the plans required to be submitted pursuant to § 145-4 of this chapter. Each park unit shall contain at least 5,000 square feet and shall have, where conditions require, a concrete or macadam base on which the mobile homes shall be placed, such base having a minimum size of 10 feet by 50 feet. No more than one mobile home shall be permitted to occupy any one park unit. All mobile homes, including additions and appurtenances, shall have a minimum front yard of 20 feet, a minimum side yard of 10 feet on each side and a minimum rear yard of 25 feet. The mobile home lot shall be grouped in blocks with streets at least 50 feet wide between each block. Each street shall be treated with a double penetration macadam surface or shall otherwise be constructed in a manner sufficient to insure a proper travelling surface at all times during the year and under all conditions. Each mobile home lot shall have direct access to a street. No mobile home lot shall be located within 50 feet of a public highway or public street line nor within 50 feet of an adjacent property line nor 75 feet of any adjacent dwelling house. Each mobile home lot and all parts thereof shall be kept in a clean and sanitary condition at all times.[1]

C. 
Water connection. Each mobile home park shall be provided with proper water connection on each mobile home lot.
D. 
Water supply. A sufficient supply of pure drinking water shall be provided to each mobile home lot.
E. 
Any park unit on which is parked or located any mobile home not containing a water closet, lavatory and a shower or bathtub and hereinafter called a "dependent mobile home" shall be provided with toilets, showers, slop sinks and other sanitary facilities which shall conform to the following requirements:[2]
(1) 
Toilet facilities for males shall consist of not less than one flush toilet for every 15 dependent mobile homes, one urinal for every 15 dependent mobile homes, one shower with individual dressing accommodations for every 10 dependent mobile homes and one lavatory for every 10 dependent mobile homes.
(2) 
Toilet facilities for females shall consist of not less than one flush toilet for every 10 dependent mobile homes, one shower with individual dressing accommodations for every 10 dependent mobile homes and one lavatory for every 10 dependent mobile homes.
(3) 
The toilet and other sanitary facilities for males and females shall either be in separate buildings or shall be separated, if in the same building, by soundproof walls.
(4) 
There shall be provided in addition in a separate compartment not less than one slop sink or other like facility with an adequate supply of hot running water.
(5) 
All service buildings shall be of substantial construction and shall be maintained in a clean, sanitary and sightly condition and kept free of any condition that would adversely affect the health of any occupant or the public or constitute a nuisance.
(6) 
All service buildings if in operation between October 1 and May 1 of each year shall be properly heated.

F. 
Disposal of sewage, where made into a private system, will include a sanitary means of disposal, the operation of which creates neither a nuisance nor a menace to health and it is the responsibility of the owner or the operator of the said mobile home park to provide such sewage disposal system for each mobile home lot to be done in such a manner that no odors are created or unsanitary conditions result.
G. 
Garbage receptacles. Each mobile home park shall provide equipment sufficient to prevent littering on the grounds and premises with rubbish, garbage and refuse and provide fly-tight metal depositories with tight fitting covers at conspicuous locations upon such premises. Such depositories shall be emptied regularly and kept, at all times, in sanitary condition.
H. 
Electrical service and connections. Each mobile home park shall provide weatherproof electrical service connections and outlets for each park unit, all such connections and outlets to be of a type approved by an electrical inspection person or agency approved by the Town.[3]

A. 
The owner or operator of each mobile home shall make a permanent record in writing of all persons occupying or using the facilities of such mobile home . Said records shall be submitted to the Town Clerk at the time of making application for a permit as provided herein. Thereafter such form is to be submitted to the Town Clerk within 30 days of a change of occupancy of any of the facilities or mobile home lots of such mobile home or within 30 days of a request therefor in writing by the Town of Martinsburg. Such records shall contain the following information:
(1) 
The names and addresses of each occupant of each mobile home lot, together with ages of all children.
(2) 
The date of arrival at said mobile home .
(3) 
The name and address of the owner of each mobile home including a description of the mobile home, year of manufacture, overall dimensions.
(4) 
The number of the mobile home lot upon which each such mobile home is located.
B. 
Within 30 days after the departure of any mobile home the owner or operator of each mobile home shall notify the Town Clerk in writing of the date of such departure.
