Any peace officer or any constable or other agent or employee
of the Town of Martinsburg at the direction of the Town Board of the
Town of Martinsburg shall have the right, at any reasonable time,
to enter any mobile home or trailer and shall have the right, at
all times, to inspect all parts of said premises and to inspect the
records required to be kept in any mobile home or trailer .
If any mobile home or trailer is not being maintained in a
clean and sanitary condition or is not being conducted in accordance
with the provisions of this chapter or of the New York State Sanitary
Code, or if the fees provided for herein have not been paid or if
the registration provisions provided for herein have not been carried
out, upon the receipt of such information, the Town Board of the Town
of Martinsburg may direct the Town Clerk to serve an order in writing
upon the holder of the permit or the persons in charge of such mobile
home park or trailer park directing that the conditions therein specified
be remedied within 10 days after the date of service of such order.
If such conditions are not corrected at the expiration of said ten-day
period, the Town Board of the Town of Martinsburg may cause a notice
in writing to be served upon the holder of said permit to appear before
the Town Board of the Town of Martinsburg, at a time to be specified
in such notice and show cause why such mobile home park permit or
trailer park permit should not be revoked. The Town Board may, after
a hearing at which testimony of witnesses may be taken, and at which
the holder of the permit shall be heard, revoke such permit if said
Town Board shall find that said mobile home park or trailer park is
not being maintained in a clean and sanitary condition or if they
find that any provisions of this chapter have been violated or that
the fees provided for herein have not been paid or for other sufficient
cause. Upon revocation of such permit, the premises shall immediately
cease to be used for the purpose of a mobile home park or trailer
park.
