Pursuant to the authority conferred by Article 16 of the Town
Law and Articles 2 and 3 of Municipal Home Rule Law of the State of
New York, the Town Board of the Town of Lowville hereby adopts and
enacts the following chapter.
This chapter shall be known as the "Town of Lowville Zoning
Law."
A.
The purposes of this chapter are:
(1)
To provide for orderly growth in accordance with a Comprehensive
Plan;
(2)
To lessen congestion in the streets;
(3)
To secure safety from fire, flood and other dangers;
(4)
To provide adequate light and air;
(5)
To prevent the overcrowding of land;
(6)
To avoid undue concentration of population;
(7)
To make provision for, so far as conditions may permit, the accommodation
of solar energy systems and equipment and access to sunlight necessary
therefor;
(8)
To facilitate the adequate provision of transportation, water, sewerage,
schools, parks and other public requirements; and
(9)
To promote the health, safety and general welfare of the public.
B.
This chapter has been made with reasonable consideration, among other
things, as to the character of each zone and its peculiar suitability
for particular uses, and with a view to conserving the value of buildings
and encouraging the most appropriate use of land.
This chapter, and any amendment thereto, shall apply on its
effective date to all uses which have not been substantially commenced,
and structures which have not been substantially constructed, regardless
of the status of permits or certificates of occupancy issued pursuant
to the New York State Uniform Fire Prevention and Building Code.
This chapter shall replace and supersede the prior existing
Zoning Ordinance of the Town of Lowville when adopted pursuant to
law.
