No septic tank and/or leaching field shall be installed anywhere in the Village of Washingtonville except as herein provided. No privies shall be permitted except those for temporary use in construction work as herein provided. No rock cesspools shall be installed except as herein provided.

No installation of any septic tank and leaching field for the disposal of excreta from any structure intended for human use or occupancy shall be commenced until a building permit application has been duly filed on forms supplied by the Sanitary Inspector, said forms to include drawings showing the intended location of the system. These drawings shall show all distances, sizes of equipment, grades, depth of trench, stone, fill, etc. No work on any septic installation shall be begun until the application and specifications are approved by the Sanitary Inspector.

A. 

An application for a permit shall be made on all new installations and on all replacement work. With each application made, regardless of the extent of the work, a fee shall be paid to the Village of Washingtonville, as set by the Board of Trustees by resolution.

B. 

This provision shall apply to all developments regardless of the fact that their sewage layout has been approved by the New York State Board of Health. All such installations shall be subject to the provisions of this Article.

The Sanitary Inspector shall be the Village Engineer. It shall be the duty of the Village Engineer:

A. 

To receive applications and specifications from the contractor or owner installing the system.

B. 

To investigate the proposed installation and approve or disapprove the application or specifications.

C. 

If approved, to issue a permit for the installation of the system indicated.

D. 

To enforce the provisions of this Article.

E. 

To report to the Village Board of Trustees at each monthly meeting or when requested to do so by the Village Board.

The standards, rules and regulations set forth in 10 NYCRR Part 75, as the same may be amended from time to time, shall be of full force and effect within the village.

Nothing contained in this Article shall be construed to permit the installation or maintenance of disposal facilities which are or may become a nuisance.

Any violation of this Article either by the occupancy of a structure without a duly authorized certificate of approval or by the installation or use of septic tank, leaching pit, privy or discharge pipe, without compliance with the terms and provisions aforesaid, or any violation of any terms and provisions of this Article is hereby declared to be a misdemeanor and shall render the owner of the land whereon the same was installed or the tenant or the person so installing the same or any other person guilty of a violation thereof liable to a fine not to exceed the sum of $250 or to imprisonment for a period of not more than 15 days, or both. Each week's continued violation after notice thereof shall constitute a separate additional violation.
