Exemptions; waiver. 

Off-street parking and truck loading space requirements shall be provided for and kept available as an accessory use to all permitted and accessory uses of buildings, structures and land in amounts not less than those specified in this article.

A. 

The requirement for a simple use (e.g., a single-family residence or a retail store) shall be determined directly from the related provision of this article.

B. 

The requirement for a use made up of several component uses (e.g., a bowling alley with auditorium seating and a restaurant and bar, or a retail store and office building) shall be determined by establishing the requirements for each component use and adding them together.

C. 

When the required number of spaces is determined to be a fraction, it shall be increased to the next highest whole number.

D. 

If a use is not specifically listed in this article, the requirement shall be the same as the most similar listed use.

Off-street parking requirements for residential uses shall be as follows:

A. 

Single-family, two-family and apartment-type multiple dwellings: two parking spaces for each dwelling unit.

B. 

Boarding- or lodging house, hotel, motel, resident membership club or country club or tourist home:

(1) 

One parking space for each guest bedroom or guest suite; and

(2) 

Two parking spaces for each three employees customarily on the property at one time.

C. 

Mobile home court: two parking spaces for each mobile home space.

Off-street parking requirements for nonresidential uses shall be as follows:

A. 

Auditorium, church, convention hall, stadium, theater, studio or other place of public assembly not otherwise classified:

(1) 

One parking space for each three fixed seats of capacity; or

(2) 

One parking space for each 40 square feet of floor area available to patrons in cases where the capacity is not determined by the number of fixed seats. The capacity of benches shall be calculated at one person for each 20 inches of length.

B. 

Bank or savings and loan association: one parking space for each 150 square feet of floor area.

C. 

Bowling alley: four parking spaces for each alley.

D. 

Business center development, retail store or personal service store: one parking space for each 75 square feet of total building floor area available to patrons.

E. 

Drive-in restaurant, refreshment stand or outdoor retail establishment: one parking space for each 40 square feet of area devoted to retail sales, kitchens and the display of merchandise.

F. 

Filling station, public garage or service station: sufficient parking spaces for all vehicles stored or being serviced at one time and a minimum of five additional parking spaces.

G. 

Funeral home: one parking space for each 40 square feet of floor area of public rooms.

H. 

Home occupation or home professional office: one parking space for each 200 square feet of area given over to this component of the land use, but in no case fewer than two parking spaces.

I. 

Hospital.

(1) 

One parking space for each bed; and

(2) 

Two parking spaces for each three doctors, staff members or employees customarily on the property at one time.

J. 

Mailbox or group of mailboxes. Ample hard-surfaced space shall be allowed between the traveled roadway and the mailbox so that the letter carrier's vehicle may be parked off the roadway when delivering mail.

K. 

Manufacturing or industrial establishment, research institute or laboratory: two parking spaces for every three employees customarily on the property at one time.

L. 

Offices and office buildings:

(1) 

One parking space for each 200 square feet of floor area; or

(2) 

Two parking spaces for every three employees customarily on the property at one time, whichever is the greater.

M. 

Professional office in a residential building: one parking space for each 150 square feet of floor area.

N. 

Public library, art gallery or museum: one parking space for each 200 square feet of floor area available to patrons.

O. 

Restaurants, taverns or clubs: one parking space for each 45 square feet of floor area available to patrons or members.

P. 

School:

(1) 

One parking space for each employee; and

(2) 

One parking space for each eight pupils in the 11th and 12th grades or above; or

(3) 

The parking requirement for the auditorium or gymnasium component of the use, whichever is the greater.

Q. 

Studio or shop for custom work: one parking space for each 150 square feet of floor area.

R. 

Wholesale establishment: two parking spaces for every three employees customarily on the property at one time or engaged in making deliveries from properties used as distribution points, but not less than one parking space for each 600 square feet of gross floor area or property area actively occupied by the establishment.

S. 

Child day-care center:

(1) 

One parking space for every six children, based on the maximum number of children that may be registered; and

(2) 

One parking space for each employee or other person working at the premises.

Every building or structure, lot or land used for nonresidential purposes shall be provided with off-street truck loading spaces in accordance with the following schedule:

A. 

Access driveway arrangements for a public garage, public parking area, filling station, service station or car washing station may have separate or combined entrances and exits.

B. 

Every entrance or exit access driveway shall have a minimum unobstructed width of 10 feet. Every combined entrance and exit access driveway shall have a minimum unobstructed width of 20 feet.

C. 

All access driveways within parking areas shall have a minimum total unobstructed width of 22 feet.

A. 

Existing buildings and uses are exempt. The provisions of this Article shall not apply to any building or structure, lot or land in use lawfully at the effective date of this chapter, whether continued as a permitted or a legal nonconforming use or thereafter converted or changed without enlargement to a different lawful use.

B. 

General waiver of requirements of nonresidential uses. The Board of Appeals, subject to the applicable provisions of § 175-127, may waive the requirements, in whole or in part, for off-street parking stipulated in this Article.
