It shall be the duty of the Commissioner of the Department of
Planning and Development or his designee and he is hereby given the
power and authority to enforce the provisions of this chapter.

The Commissioner of the Department of Planning and Development
or his designee shall make a monthly report to the Town Board of fees
collected by him.

A. The Plumbing Inspector shall be an assistant to the Commissioner
of the Department of Planning and Development.
B. The Plumbing Inspector shall examine applications for permits required
by this chapter, and if the applications are found to comply with
the provisions of this chapter, the permit for the work specified
shall be issued; he shall also examine all plumbing work as it is
being installed or performed to see that it complies with the provisions
of this chapter and the conditions of the permit.
C. Whenever the Plumbing Inspector finds, upon examination, that a violation
of a provision of this chapter or any unsafe or unhealthful condition
exists, he shall endeavor to compel an immediate correction of the
condition. Failing in this, he shall make a report of the condition
deemed to be unsafe or unhealthful or in violation of this chapter
and deliver a copy of the report to the owner, agent or other person
in charge of or in control of the premises, and report the violation
to the Commissioner of the Department of Planning and Development
or his designee who shall enforce the provisions of this chapter by
any appropriate remedies as provided by law or equity.
In the discharge of his duties, the Plumbing Inspector shall
have authority to enter any premises, building or structure.
The Plumbing Inspector shall keep a record of permit applications
filed, permits issued, certificates issued, reports, notices and orders
issued.
All details of plumbing work not otherwise provided for in this
chapter shall be of a kind and quality approved by the Plumbing Inspector.

A. Each person who shall violate any provision of this chapter or regulations
adopted thereunder shall be guilty of a violation punishable by a
fine of not more than $350 or by imprisonment of not more than 15
days, or by both such fine and imprisonment for each such offense.
The owner of a building, structure or premises or part thereof where
anything in violation of this chapter shall be placed or shall exist,
and any architect, building contractor, agent, person or corporation
employed in connection therewith and who may have assisted in the
commission of such violation shall each be guilty of a separate offense,
and, upon conviction thereof, shall be punished as provided in this
section.
B. The imposition of the penalties prescribed for a violation of this
chapter shall not preclude the Town Attorney from instituting any
appropriate action or proceeding to prevent an unlawful erection,
construction, reconstruction, alteration, repair, conversion, maintenance
or use, or to restrain, correct or abate a violation, or to prevent
an illegal act, conduct, business or use in or about any premises.

Any person found by the Bureau of Administrative Adjudication
to have violated any provision of this chapter shall be subject to
a monetary penalty within the range of fines authorized herein.

No oversight or dereliction of duty on the part of the Commissioner
of the Department of Planning and Development or his designee shall
legalize the erecting, construction, alteration, removal of use or
occupancy of a building or structure that does not conform to the
provisions of this chapter.
