The Township of Smith hereby recognizes the Slovan Volunteer
Fire Company which has been organized by residents of said Township.

The Slovan Volunteer Fire Company is hereby given all power,
so far as the Township has power to grant the same, to enact such
rules and regulations for the management and government of individual
members thereof as shall be necessary for the proper maintenance and
control of said Volunteer Fire Company. Neither the grant of the aforesaid
power nor the recognition set forth in § 101 shall be construed
as constituting the Slovan Volunteer Fire Company as an agent, department,
or employee of the Township except insofar as such effect is provided
under the provisions of the act of June 2, 1915, P.L. 736, No. 338,
known as the Pennsylvania Workmen's Compensation Act," or the
act of November 26, 1978, P.L. 1399, No. 330, known as the "Political
Subdivision Tort Claims Act."

The members of Slovan Volunteer Fire Company may elect from
their number such officers as may be provided by the bylaws of the
Fire Company.
The Slovan Volunteer Fire Department shall initiate mitigation
rates for the delivery of emergency and nonemergency services by the
Fire Department for personnel, supplies and equipment to the scene
of emergency and nonemergency incidents as listed in Exhibit A.[1] The mitigation rates shall be based on actual costs of
the services and that which is usual, customary and reasonable (UCR)
as shown in Exhibit A, which may include any services, personnel,
supplies, and equipment and with baselines established by addendum
to this document. The costs associated with Exhibit A may be amended
from time to time by resolution.

A claim shall be filed to the responsible party through their
insurance carrier. In some circumstances, the responsible party will
be billed directly.
The Fire Department and the Township Board may make rules or
regulations and from time to time may amend, revoke, or add rules
and regulations, not consistent with this section, as they may deem
necessary or expedient in respect to billing for these mitigation
rates or the collection thereof.
