It is the purpose of this article to abolish the three elected offices of Assessor of the Town of Lumberland and to establish the part-time appointive position of Assessor under §§ 328 and 310 of the Real Property Tax Law of the State of New York.
This article is adopted pursuant to § 328 of the Real Property Tax law and § 24 of the Municipal Home Rule Law.
The three elected offices of Assessor of the Town of Lumberland shall be abolished as of 12:00 midnight on January 31, 1993. The Town Board of the Town of Lumberland shall appoint a qualified person to the office of Assessor at its monthly meeting to be held on February 10, 1993.
The first term of office of the appointed Assessor shall be from February 11, 1993 to September 30, 1995, unless otherwise changed pursuant to Real Property Tax Law § 310.
The subsequent terms of office shall be for six consecutive years commencing October 1, 1995, all pursuant to § 310 of the Real Property Tax Law of the State of New York.
The local law shall be subject to a permissive referendum. In the event a petition with sufficient valid signatures and in prescribed form is presented to and certified by the Town Clerk, a special election shall be held, on a date to be determined by the Town Board, within 60 days of certification of said petition(s).
