The Building Department is hereby created and the official in charge thereof shall be known as the "Building and Zoning Official."
The Building and Zoning Official shall be appointed by the Village President of the Village of Coal City, with the advice and consent of the Board of Trustees. The Building and Zoning Official's salary shall be determined by the Board of Trustees as set from time to time.
The Building and Zoning Official shall have all those powers set forth within the adopted building standards provided in § 150-1 and as otherwise set forth in the Village Code and any other applicable laws and regulations and shall report to the Village Administrator unless otherwise directed by the Board of Trustees.
The Village President, with the advice and consent of the Board of Trustees, shall have the authority to hire a Deputy Building and Zoning Official, the related technical officers, inspectors, plan examiners and other employees. Such employees shall have powers as delegated by the Building and Zoning Official and said employees shall be paid as determined by the Board of Trustees. For the maintenance of existing properties, the Building and Zoning Official shall abide by terms of the International Property Maintenance Code.
The Building and Zoning Official shall have the power to order all work stopped on construction, alteration, or repair of buildings in the Village when the work is being done in violation of any provision of any ordinance relating thereto. Work shall not be resumed after the issuance of a stop order except on the written permission of the Building and Zoning Official. However, if the stop order is an oral one, it shall be followed by a written stop order within 12 hours. The written stop order may be served by any employee of the Village.
Whenever any officer or employee of the Village is authorized to enter any building or premises for the purpose of making an inspection to enforce any ordinance, the officer or employee may enter such building or premises at all reasonable times to inspect the same; provided that the officer or employee shall effect entry in the manner provided in § 32-56, except in emergency situations, or when consent of the person having charge or control of such building or premises has been otherwise obtained.
If the building or premises to be inspected is occupied, the authorized officer or employee shall first present proper credentials and demand entry; and if such building or premises is unoccupied, the officer or employee shall first make a reasonable effort to locate the owner or other person having charge or control of the building or premises and demand entry. If consent to such entry is not given, the authorized officer or employee shall have recourse to every remedy provided by law to secure entry.
In accordance with Section 112 of the International Building Code, appeals of orders, decisions or determinations made by the Building and Zoning Official relating to application and interpretation of the International Building Code shall be heard by the Zoning Board of Appeals as set forth in § 156-313 of the Village Code.
