GENERAL REFERENCES
Industrial waste regulations — See Ch. 52.
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
GARBAGE
Includes all refuse, accumulation of animal, fruit or vegetable matter that attends the preparation, use, cooking, dealing in or storage of meat, fish, fowl, fruits or vegetables, and containers originally used for foodstuffs.
REFUSE
Garbage, rubbish, or both.
RUBBISH
Includes all other refuse not defined under "garbage" except rocks, concrete, bricks and similar solid material, plaster or dirt.

All garbage created, accumulated or produced shall be deposited in containers provided in accordance with the Village's current waste management contract. Containers shall be kept in a clean, neat and sanitary condition at all times.

It shall be the duty of every person in possession, charge or control of any place in or from which garbage is created, accumulated or produced to provide, and at all times keep in a suitable place readily accessible to the garbage collector, garbage containers capable of holding all garbage which would ordinarily accumulate on such premises between the time of successive collections. The owner or occupant of a multiple-family dwelling containing more than four units shall provide private garbage collection service according to the current waste management contract.

Rubbish, except broken glass, may be deposited in garbage containers. Human waste and other potentially infectious material shall not be deposited or placed in garbage containers unless such material is wrapped in a manner satisfactory to the waste hauler contractor. Liquid garbage shall not be deposited in such containers except in a sealed container. Kitchen garbage shall be drained of all moisture and completely wrapped in paper or plastic before it is placed or deposited in garbage containers.
No garbage containers or other containers for refuse, other than those of the Village, shall be placed, kept, stored or located within the right-of-way of a street or alley.

A. 
It is found that the periodic collection of garbage and refuse from all single-family dwelling units and multiple-family dwelling units less than five units benefits all occupants of places and premises in the Village; such occupants or persons in possession, charge or control of any single-family dwelling unit or multiple-family dwelling unit of less than five units are liable for and shall pay the garbage collection fees established by the Village Board.
B. 
Garbage collection services are provided by the Village, and it shall be mandatory for all occupants or persons in possession, charge or control of all single-family dwelling units or multiple-family dwelling units of less than five units in the Village to use the Village's collection service.
C. 
It shall be unlawful for any person other than the authorized agents or employees of the Village to collect, remove or dispose of garbage from single-family dwelling units or multiple-family dwelling of less than five units in the Village; provided, however, that nothing contained in this section shall prevent the use of garbage disposal devices.

A. 
Collection of garbage shall be made at least once a week from single-family dwelling units and multiple-family dwelling of less than five units, or as many times per week as the waste hauler contract may require.

B. 
It shall be a violation of this section for any person, firm, corporation or entity of any kind to place garbage, recyclable materials or other wastes of any nature and kind for collection by the contract garbage hauler at the curbside or other designated collection area more than 48 hours prior to the scheduled collection time. Upon the intended collection time, garbage containers must be retrieved by the resident and returned to his or her premises in compliance with the § 150-1 of the Village Code, within 24 hours.

The fees to be paid by owners and occupants of single-family dwelling units or multiple-family dwellings of less than five units for the collection of garbage shall be determined from time to time by resolution of the President and the Village Board. Notification of each successive change in such fees shall be given by delivery of a written schedule thereof to each person receiving garbage collection service. Delivery of such schedule may be by United States regular mail.

No person or persons shall burn garbage or rubbish within the Village limits. Nothing herein shall prohibit any person from burning leaves and tree limbs in conformity with the applicable local and state law, including Chapter 92, Fire Prevention, Article III, §§ 92-40 through 92-43, of the Code.
The keeping of garbage in containers other than containers prescribed by this chapter or the keeping upon premises of garbage or rubbish which is allowed to become offensive and noisome shall constitute a public nuisance and may be abated in the manner provided by law for the abatement of nuisances.

A. 
All recyclables, including tin and aluminum cans, clear glass, brown glass, green jars and bottles, chip boards, newsprint and #1 and #2 plastic, shall become the property of the Village's current refuse and recycling contractor upon the placement of such items upon the household curbside for disposal.
B. 
It shall be a violation of this section for any person, firm, corporation or entity of any kind unauthorized by the householder or the Village's current refuse and recycling contractor to collect or cause to be collected any of the recyclable items named in this section from the curbside bins. Any and each such collection in violation of this section shall constitute a separate and distinct offense punishable as provided in § 50-99.

A. 
It shall be unlawful for any resident of the Village to dispose of any garbage, refuse or rubbish other than in orderly containers for collection at the curbside of each resident on the scheduled garbage day.
B. 
It shall be unlawful for any person to dispose of any garbage, refuse or rubbish on any public property, private property of a third party, roadway, street or alley, either within the corporate limits of the Village or outside the limits of the Village.

Whoever violates any provision of this chapter for which no other penalty is specified shall be subject to the penalty set forth in § 10-99 of the Code.
