A. 
No person shall engage in the retail sale of tobacco products or operate a facility containing vending machines that dispense tobacco products unless the person is authorized to do so by a license issued under this section.
B. 
An application for a tobacco product retailer's license shall be filed in writing with the Village Clerk on a form provided by the Village and in conformance with the provisions relating to licenses generally, and shall specify the location of each point of sale maintained by the retailer.
C. 
The Village President or his or her designee shall administer the licensing of tobacco product retailers and shall approve or deny all applications and revoke existing licenses as provided herein.
D. 
In addition to the penalties set forth in § 117-99, any person, corporation or business who or which violates any provision of this chapter, following a notice and hearing, the Village President may suspend or revoke the license of the retail tobacco product dealer.
E. 
The annual license fee for the retail sale of tobacco products shall be $25.

No person, firm, or corporation, either by means of an automatic vending machine or otherwise, shall sell, give away, barter, exchange, or otherwise deal in tobacco products at any place located within 100 feet of any building used exclusively for school purposes. It shall be the duty of the President and he or she is authorized and empowered from time to time to inspect and examine all places where tobacco products are licensed to be sold within the Village for the purpose of prohibiting any violation of this chapter.

Every public place where tobacco products are sold, either by means of an automatic vending machine or otherwise, shall be kept in a clean and sanitary condition for the health, safety, and comfort of its patrons.

A. 
It is unlawful for any person to sell, offer for sale, give away or deliver tobacco products to any person under the age of 18 years, including but not limited to through the use of a vending machine.
B. 
Signs informing the public of the age restriction provided for herein shall be posted at every location where tobacco products are displayed and offered for sale and on every vending machine which offers tobacco products for sale within the Village. Such signs shall be plainly visible and shall state:
"THE SALE OF TOBACCO PRODUCTS TO PERSONS UNDER 18 YEARS OF AGE IS PROHIBITED BY LAW."
C. 
It is unlawful for any person under the age of 18 years to possess any tobacco products of any kind; provided that such possession by a person under the age of 18 under the direct supervision of the parent or guardian of such person in the privacy of the parent's or guardian's home shall not be prohibited.

Whoever violates any provisions of this chapter for which no other penalty is specified shall be subject to the penalty set forth in § 10-99 of the Code.
