A. 
Sidewalks shall be installed on every lot within the Village by every person who erects a building or structure on the lot after September 1, 1996, including on both sides of the street in residential subdivisions as required by Chapter 155, Subdivision Regulations, § 155-57F(6); unless the Village Board exempts the person because the facts and circumstances of the situation as determined by the Village Board do not require the installation of a sidewalk.
B. 
No building permit, as regulated by the Building Code, shall be issued by any governing official for the construction of any building or structure on any lot within the Village until such time as a satisfactory plan for the construction of a public sidewalk, together with a completion bond, deposit of cash, or other security or guaranty in an amount satisfactory to the Building and Zoning Official, shall be filed with the Village Clerk.
C. 
The bond or deposit of cash or other security required by this section shall be returned to the party posting the same, upon the completion of the sidewalk in accordance with the specifications set forth in § 150-21.
Sidewalks shall be located 12 inches from the street right-of-way line and shall be constructed in accordance with the following:
A. 
General requirements. All sidewalks shall be constructed of portland cement with a twenty-eight-day compression strength of 3,500 pounds. Minimum slump shall be three inches; maximum slump shall be six inches. All concrete shall be air entrained. Other admixtures shall be approved by the Village Engineer.
B. 
Residential districts: minimum width shall be four feet; minimum thickness shall be four inches, over a compacted three-inch granular base.
C. 
Commercial districts: minimum width shall be five feet; minimum thickness shall be five inches, over a compacted three-inch granular base.
D. 
In residential areas and commercial areas, at locations where sidewalks are constructed through a driveway, the sidewalk thickness shall be increased to six inches and a welded wire mesh shall be placed in the concrete placement.
E. 
Grade.
(1) 
Sidewalk grades must be approved by the Village Building Inspector or Village Engineer and sidewalks, which are the construction responsibility of the lot owner, shall not be constructed with the subdivision improvements, but shall be constructed upon completion of the building on individual lots prior to occupancy.
(2) 
In general, the grade of the residence edge of the sidewalk shall be five inches above the top of curb. The sidewalk shall have one inch slope toward the curb. The Building Officer may approve sidewalks to be placed at grades above or below this recommended grade.
The public sidewalk provided for in this article shall be completed within six months after the building or structure for which the building permit was issued is completed and occupied. After the expiration of the time limit above, if the sidewalks are not completed, the Village may complete or cause the sidewalk to be completed and apply the proceeds of the completion bond, deposit or other security toward the costs thereof, refunding any excess to the party posting the same.
