The Will County Stormwater Management Ordinance, as amended on November 28, 2018, is hereby adopted by reference and is in full force and effect within the Village of Coal City and shall be treated as if set forth in full herein. At least one copy of the Stormwater Management Ordinance has been and is now filed in the office of the Village Clerk.
For the areas within the Village not in Will County, the regulations of the Will County Stormwater Management Ordinance shall be enforced and administered by the Village. Interpretation of the Will County Stormwater Management Ordinance in the areas of the Village not in Will County shall be as follows:
A. 
All references to "administrator" and "director" shall be interpreted to mean the Village Administrator or his or her designee;
B. 
Any applicable committee or department functions referenced in the Will County Stormwater Management Ordinance that are necessary to be performed in the portions of Coal City in Grundy County shall be performed by the Coal City Planning Commission; and
C. 
All references to "county" shall be interpreted to mean the Village of Coal City.
D. 
The Federal Emergency Management Agency (FEMA) conducted Flood Insurance Studies (FIS) on two occasions in which Coal City municipally incorporated land exists. The findings of these studies are adopted by reference; they include the FIS of Grundy County dated August 2, 2012, and the associated Flood Insurance Rate Map (FIRM) panels 17063C0150F and 17063C0145F dated August 2, 2012, as well as the FIS of Will County dated February 15, 2019, and the associated FIRM panel 17197C0415G dated February 15, 2019.

A. 
Any development constructed pursuant to a stormwater management permit shall be subject to periodic inspections by the Village Administrator or the Village Engineer, or his or her designee, to ensure conformity with the permit provisions and conditions.
B. 
Any person who violates, disobeys, omits, neglects, refuses to comply with, or resists the enforcement of any provision of the Will County Stormwater Management Ordinance in Grundy County ("ordinance violation") or any requirement or condition in any permit issued pursuant to this chapter ("permit violation"), and, in the case of a permit violation, fails to correct such violation, omission or neglect, or cease such disobedience, refusal or resistance after notice and reinspection, shall be guilty of an offense under this section and subject to the penalties in § 153-99.
C. 
The Village Engineer or the Village Administrator, or his or her designee, shall be able to determine if a permit violation or other offense exists under any portion of the Will County Stormwater Management Ordinance in Grundy County and shall cause issuance of a citation for same.

Whoever violates any provisions of this chapter for which no other penalty is specified shall be subject to the penalty set forth in § 10-99 of the Code. In addition, the Village may also:
A. 
Seek other appropriate judicial action, including mandatory injunctions;
B. 
Revoke previously issued permits; and/or
C. 
Issue an order requiring the suspension of any further work on the site. If a stop-work order is issued, it shall be in writing, indicate the reason for its issuance, and shall specify the action, if any, required to be taken in order to resume work.
