East Lansdowne Fire Company No. 1, a volunteer fire company now in service in the Borough of East Lansdowne, is hereby recognized as the official Fire Department of the Borough of East Lansdowne. The recognition hereby granted to said fire company shall be subject to withdrawal by Borough Council in the event that said fire company shall fail to comply with the provisions of this Part 5B, as hereinafter set forth.

The Borough Fire Department shall be under the general supervision and direction of the Borough Council.

The said East Lansdowne Fire Company No. 1 is hereby authorized and permitted:
1. 
To make use of the Engine Room located in the Borough's Town Hall Building for the housing of such fire apparatus, firefighting equipment and such other equipment or furnishings as shall be specifically authorized to be housed therein by Borough Council. Use and occupancy of said Engine Room shall, in all respects, be subject to and in conformity with such regulations as may from time to time be adopted by resolution of Borough Council.
2. 
To make use of the Recreation Room located in the basement of said Building for the recreation of its members during such hours and on such days as shall, from time to time, be established by resolution of Borough Council. Provided, however, that no equipment, machinery, furniture or property of any kind or nature whatsoever, shall be housed in said Room, or brought into said Room for use therein, unless specifically authorized in writing by Borough Council.
3. 
To have the use of, exclusively for firefighting and training purposes, the Borough's fire siren and such other Borough owned fire apparatus and firefighting equipment as shall be specifically designated by Borough Council for use by said Fire Company. Use of said fire siren shall be in accordance with and subject to such regulations as may from time to time be adopted by resolution of Borough Council.

To the extent permitted by law, Borough Council shall annually make provision in the Borough budget for such funds as Borough Council shall deem sufficient for the proper operation of the Fire Department, including the maintenance of all necessary fire apparatus and firefighting equipment; and such funds shall be retained by the Borough and paid directly to the persons, firms or corporations rendering services or furnishing materials which Borough Council shall deem are necessary to the proper operation of the Fire Department, as aforesaid.

No fire apparatus or firefighting equipment owned by the Borough, and no fire apparatus or firefighting equipment as to which the Borough maintains public liability insurance or which is operated or maintained, in whole or in part, by Borough funds, shall be used by the Fire Department for any purpose other than firefighting or training for firefighting unless specific authorization for such use shall first have been obtained from Borough Council.

No fire apparatus or firefighting equipment or any other kind or type of equipment, apparatus or vehicles shall be housed in the Engine Room of the Borough's Town Hall Building, or parked or stored in or about said building or on the cartways, sidewalks or driveways abutting on said building without the permission in writing of Borough Council first having been obtained.

The Fire Department shall have the duty and responsibility of training the members of said Department for firefighting and shall have the right to use the aforesaid fire apparatus and firefighting equipment for training purposes; provided, however, that no part of the apparatus or equipment referred to in § 1-525, supra, shall be used for training purposes except at such times and places as shall be specifically designated from time to time by resolution of Borough Council.

The Fire Department shall protect and preserve all fire apparatus and equipment referred to in § 1-525, supra, and shall, upon demand of Borough Council, make such apparatus and equipment available for inspection by Borough Council or any member or Committee designated by Borough Council.

The fire apparatus and equipment referred to in § 1-525, supra, may be used beyond the municipal boundaries of the Borough of East Lansdowne for the purpose of rendering firefighting services to other municipalities, but no such apparatus or equipment shall be used or removed beyond the Borough limits for any other purpose without the consent of Borough Council.

The Fire Company shall certify to Borough Council on or before January 1st of each year, the names of the two members selected by said Company for the position of Fire Chief and Assistant Fire Chief, respectively. The members so certified shall serve in said offices for a term of one year commencing on January 1st of the year for which they have been certified. Provided, however, that, in addition to any other penalty hereinafter imposed, the Fire Chief and the Assistant Fire Chief shall be subject to removal by Borough Council for violation of any of the provisions of this Part 5B.

The Fire Chief, or in his absence, the Assistant Fire Chief, shall have the responsibility and duty:
1. 
To see that the fire apparatus and equipment referred to in § 1-525, supra, is maintained, used and housed in strict accordance with the provisions of this Part 5B;
2. 
To manage and direct said apparatus and equipment and the members of said Company while in service at fires and during authorized training drills;
3. 
To keep complete records of all fires and to submit monthly reports to Council, or to a committee designated by Council, showing all firefighting activities during the monthly period covered by the report;
4. 
To report immediately to the Borough Secretary all loss or damage to any fire apparatus or equipment referred to in § 1-525, supra, all accidents or collisions involving the use of such apparatus or equipment, and all injuries suffered by any member of said Company in the line of duty.

No fire apparatus, firefighting equipment, emergency vehicles, or vehicles of any kind, shall be used by said Fire Company for firefighting or training purposes, nor may any Borough funds be used to operate or maintain the same, unless Borough Council shall have first authorized such use and shall have included the operation and use of such apparatus, equipment or vehicles within the coverage of its public liability insurance policy or policies.

The Mayor of the Borough of East Lansdowne shall have and is hereby delegated the responsibility and duty of enforcing the provisions of this Part 5B. The Mayor may also authorize the use of any fire apparatus or firefighting equipment during the existence of any emergency conditions, notwithstanding any other provision of this Part 5B which shall require that specific authorization for use of such apparatus or equipment must be given by Borough Council.

Any person, firm or corporation who shall violate any provision of this Part 5B shall, upon conviction thereof, be sentenced to pay a fine of not more than $600; plus costs, and in default of payment of said fine and costs to a term of imprisonment not to exceed 30 days. Every day that a violation of this Part continues shall constitute a separate offense.
