The following specifications and conditions shall be satisfied by the property owners upon the acceptance of a street, road or highway and its dedication for public use:
A. 
Not fewer than five houses shall have been constructed or are substantially under construction.
B. 
The said street, road or highway shall not be less than three rods wide.
C. 
The traveled portion of the street, road or highway shall be not less than 20 feet in width, shall be brought to proper grade and shall be covered with not less than eight inches of gravel, after which the same shall be properly graded and rolled. Shoulders of not less than five feet in width shall be provided.
D. 
Drainage ditches of adequate width and depth shall be provided on both sides of the road so as to allow complete drainage of all surface water. Where the slope in the road is at an exceptionally high degree, roadside ditches shall be surfaced with either macadam or concrete. At no time shall surface water be permitted to undermine the road or deposit foreign matter thereon. Banks along the sides of the ditches shall be properly sloped.
E. 
Title to the said street, road or highway shall be accepted by the Town upon the execution and delivery of a warranty deed to the premises constituting the road, street or highway. Maintenance of the same shall be undertaken by the Town as the public need presents itself. All excavations across the road for utilities, etc., shall be repaired by the property owners.
F. 
A turnaround for snowplows and other heavy equipment shall be provided by the owner on all dead-end streets.

A. 
The following are requirements for roads existing prior to 1948:

(1) 
Furnish maps of the area, showing right-of-way, drainage and grades. The right-of-way must be three rods wide and must be deeded to the Town of Lenox.
(2) 
The terminal end shall have 600 square feet of turnaround radius or connect to a main road.
(3) 
The road must be existing road since at least 1948.
(4) 
Five permanent dwellings year round are required.
B. 
An easement shall be provided for all natural drainageways when such do not fall within the dedicated rights-of-way.
C. 
Foundation course shall be at least six inches of gravel, maximum size three inches, width of base at least 18 feet, to be covered with three inches of crusher run, graded and rolled in time, prime road with 5/10 gallon to each square yard with MS 2 or equivalent product. Cover with sufficient No. 1 stone, rolled to allow safe, clean traffic. Cure for two weeks. Finish: Cover the road surface by spreading 5/10 gallon of RS 2 sealing oil or equivalent product per square yard, with a pressure distributor, heated to not less than 140° F. The surface will then be chinked with sufficient No. 1 stone and rolled with a heavy roller.
D. 
Waterlines and gas lines shall be installed before the road is completed. All underground surface pipe for water and gas mains shall be installed six feet off the Town line. Telephone and light poles shall be four feet off property lines or in agreement with the Town Superintendent of Highways.

E. 
Corrugated pipe of at least 12 inches or larger will be used in driveways. All necessary sluices, culverts, driveways and bridges, if any, will be furnished by the owner and installed by the Town.
F. 
The Town Superintendent of Highways, upon completion of the work according to said specifications, recommends to the Town Board final acceptance of the road.

G. 
The Town Board of the Town of Lenox may waive any of the above specifications for unusual hardship.
