The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

The parking of vehicles within the Residence A District and Singer Lane is hereby prohibited between the hours of 2:00 a.m. and 6:00 a.m.

A. 
Parking shall be prohibited on both sides of Dogwood Drive from the intersection of Dogwood Drive and New York State Route No. 25A to a point on both sides of Dogwood Drive 100 feet from that intersection. Additionally, parking shall be prohibited on both sides of Dogwood Drive from the Elementary School on Dogwood Drive to a point 400 feet from said Elementary School, on weekdays during the hours of 8:00 a.m. to 4:30 p.m., time then in effect.

B. 
Parking shall be prohibited on both sides of Hemlock Lane from the intersection of Hemlock Lane and New York State Route No. 25 to a point on both sides of Hemlock Lane 450 feet from that intersection.
C. 
Parking shall be prohibited on both sides of Birchbrook Drive in both places where Birchbrook Drive intersects with Lawrence Avenue. Said parking restrictions will be on both the north and south sides of Birchbrook Drive from both points of intersection with Lawrence Avenue to points 25 feet east along the north and south sides of both portions of Birchbrook Drive.

D. 
Parking shall be prohibited in the cul-de-sac area on the southerly terminus of Hemlock Lane (against the curb representing the curbed portion of the cul-de-sac) between the hours of 7:15 a.m. and 5:00 p.m., time then in effect, on any day that the Smithtown Public Schools are in regular session.

E. 
Parking shall be prohibited on the west side of Wheelright Way at the intersection with Carriage House Road, to a point 80 feet south of that intersection.

F. 
Parking shall be prohibited on both sides of Plaza Drive from the intersection of Plaza Drive and New York State Route No. 25 to a point on both sides of Plaza Drive 700 feet from that intersection.

A. 
No person shall park any motor vehicle or other vehicle as follows:
(1) 
In any commercial area within the incorporated limits of this Village, including, but not limited to, shopping center parking lots and office building parking lots, in any other manner than as designated on the surface by appropriate markings where said markings are evident.
(2) 
In any commercial area, including, but not limited to, shopping center parking lots and office building parking lots, in that area immediately next to the sidewalks adjacent to any commercial establishment where said area is designated as a fire and/or emergency zone.
(3) 
In any commercial area, including, but not limited to, shopping center parking lots and office building parking lots, in that area immediately next to the sidewalks adjacent to any commercial establishment where said area is designated as handicapped parking.

(4) 
Display of handicap permit. No person shall park any motor vehicle or any other vehicle in any area designated for handicap parking without proper display of a handicap parking permit issued by the authorized governmental agency, which permit shall be in full force and effect at the time such person uses an area designated for handicap parking. For purposes of this section, the proper display of a handicap parking permit shall mean that such permit shall be hung from the rearview mirror or placed on the front dashboard in such a manner so that the permit can be clearly read by a person or persons standing outside of said vehicle.

B. 
Penalties.

(1) 
Parking in commercial areas. Every person convicted of an infraction of any provision of this section shall, for a first conviction thereof, be punished by a fine of not more than $100. Should said fine not be paid within a thirty-day period, any person convicted of an infraction of any provision of this section shall, on said conviction, be punished by a fine of not more than $150. Should said fine not be paid within an additional thirty-day period, any person convicted of an infraction of any provision of this section shall, on said conviction, be punished by a fine of not more than $200. Should said fine not be paid within an additional twenty-five-day period, any person convicted of an infraction of any provision of this section shall, on said conviction, be punished by a fine of not more than $250.
(2) 
Parking or standing in fire zones or within 10 feet of a fire hydrant. Every person convicted of an infraction of any provision of this section shall, for a first conviction thereof, be punished by a fine of not more than $200. Should said fine not be paid within a thirty-day period, any person convicted of an infraction of any provision of this section shall, on said conviction, be punished by a fine of not more than $225. Should said fine not be paid within an additional thirty-day period, any person convicted of an infraction of any provision of the section shall, on said conviction, be punished by a fine of not more than $250. Should said fine not be paid within an additional twenty-five-day period, any person convicted of an infraction of any provision of the section shall, on said conviction, be punished by a fine of not more than $500.
(3) 
Parking in handicapped zones. Every person convicted of an infraction of any provision of this section shall be punished by a fine of not more than $230 (including surcharge).

A. 
No person shall park any commercially registered motor vehicle, except completely enclosed in a garage, on any street or any driveway or property in a residential district in the Village of the Branch, between the hours of 10:00 p.m. and 6:00 a.m., time then in effect. No person shall park any commercially used trailer on any street, driveway, or property in a residential district of the Village of the Branch.
B. 
The parking and/or storage of motor vehicles shall not be permitted in the required front yard, except on paved surfaces. For residential uses, not more than 25% of the required front, side or rear yards shall be paved surfaces, except that the maximum paved surface [1]in the required front yard shall be increased as necessary to accommodate a twelve-foot swath for a circular driveway; and the maximum paved surface in one side yard shall be increased as necessary to accommodate a driveway not exceeding 10 feet in width for access to a detached garage or increased to 50% for a side-entry garage; and all paved surfaces shall be set back at least one foot from side and rear lot lines. All paved surface materials used must be approved by the Village of the Branch Building Inspector.[2]

C. 
Exceptions. This parking requirement shall not preclude the right of any person to park a pickup truck or other vehicle having a body style for which a passenger registration may be obtained, on a street or driveway or property in a residential district of the Village of the Branch. However, such pickup truck or other vehicle shall have no visible lettering on its doors or body.
D. 
Penalties. Every person convicted of an infraction of any provision of this section shall for the first conviction thereof be punished by a fine of not more than $125; for a second conviction thereof by a fine of not more than $250; and upon a third or subsequent conviction thereof by a fine of not more than $500.

Parking in the reserved spaces at the Village Hall is prohibited for those not conducting business at the Village Hall.
