The purpose of these excavation and fill regulations is to regulate
the excavation, filling, and grading of land as an activity requiring
a permit in order to preserve and protect the land as a natural resource,
to safeguard life, limb, property and the public welfare, and to preserve
the natural environment and the stability of hillsides.
Any activity requiring an excavation and fill permit under Chapter 97, Excavating and Filling of Land, shall require a zoning permit prior to the commencement of any excavation or filling or grading of land.
Any activity exempt from an excavation and fill permit under Chapter 97, Excavating and Filling of Land, shall not require a zoning permit.
A.
An application for a zoning permit for land excavation, filling, grading or earth removal shall be submitted to the Zoning Inspector prior to the commencement of any work on the site. The permit application shall comply with all the requirements of City Code Chapter 97, Excavating and Filling of Land, specifically including § 97-4, Application.
B.
The
Zoning Inspector shall refer all applications to the Department of
Public Works for review and approval.
