A. 
It shall be unlawful for the owner of or any person harboring any dog in the Village of Carthage to permit or allow any dog to be within 25 feet of Village-owned playground equipment unless fenced, in which case five feet will apply, or within 25 feet of the Farmer's Market Pavilion or Gazebo.
B. 
Further, it shall be unlawful for any owner of, or any person harboring, any dog in the Village of Carthage to permit or allow such dog to be present at special events within the Village including the Farm and Craft Market, concerts on the Green, concerts at Turning Point Park and any sponsored parade and/or Village-sanctioned fireworks demonstration. Special events shall also include any other activity to be conducted at least in part upon Village-owned property which requires special approval or authorization from the Village, its officers, agents or employees and which is expected to attract more than 25 persons at any given time.
C. 
The prohibition herein shall not apply to dogs confined within an automobile, crate, cage or similar structure that prevents a dog from causing personal injury or damage to personal property.
D. 
The prohibition of this section may be waived by special approval granted by the Village Board or its designee.
E. 
Specifically excluded from this section is any dog defined pursuant to § 108 of the New York State Agriculture and Markets Law, as the same may be amended from time to time, as a guide dog, hearing dog, service dog, working search dog, detection dog, ward dog or any other dog that may be utilized by law enforcement agencies within the Village of Carthage or which are professionally trained service animals utilized by persons with disabilities.
