This chapter shall be known as and may be cited as the "Sellersville Borough Subdivision and Land Development Ordinance."
The purpose of this chapter is to provide for the harmonious development of the Borough by:
A. 
Assisting in the orderly and efficient integration of subdivisions and land developments within the Borough.
B. 
Ensuring conformance of subdivision and land development plans with all current, applicable and adopted Borough plans and regulations.
C. 
Ensuring the provision of adequate public facilities, including roadways, walkways, streetlighting, water supply, storm and sanitary sewage facilities, recreation sites, open spaces and other necessities and amenities of the general welfare of Borough residents.
D. 
Securing the protection of the environmental resources of the Borough.
E. 
Providing standard procedures for the equitable processing of all subdivision and land development plans.
F. 
Ensuring coordination of intermunicipal public improvement plans and programs.
G. 
Encouraging and promoting flexibility and ingenuity in the layout and design of subdivisions and land development.
H. 
In general, promoting greater health, safety and welfare of the citizens of the Borough.
Section 501 of the Pennsylvania Municipalities Planning Code[1] (Act 247) provides that Sellersville Borough may regulate subdivision and land development within the municipality by enacting a subdivision and land development ordinance.

A. 
No lot in a subdivision may be sold and no permit to erect, alter (exterior) or repair any building upon land in a subdivision, unless and until a plan of such subdivision shall have been approved and properly recorded and until the municipal improvements required by Borough Council in connection therewith shall have either been constructed or guaranteed as hereinafter provided.
B. 
No building depending for ingress and egress upon the improvement of any street or streets herein provided for shall be permitted to be occupied before such improvements are fully completed from a now-existing paved street to and across the front of the lot on which the house is located and/or to a sufficient depth along the side of the lot to service any driveway, driveways or parking spaces.
C. 
No building depending upon public water and sewer facilities shall be permitted to be occupied before such facilities are fully provided and operational.

Any person who, or entity which, has violated any of the provisions of this chapter shall, in addition to any other damages, remedies, or relief authorized by law, be liable to the Borough of Sellersville for a civil penalty not to exceed $600 per violation plus court costs and reasonable attorneys' fees incurred by the Borough of Sellersville. Violations of more than one provision of this chapter shall constitute separate violations. Each day that a violation of any provision of this chapter continues or occurs shall constitute a separate violation. Nothing contained in this section shall be construed or interpreted to grant any person or entity, other than the Borough of Sellersville, the right to commence any action for the violation of this chapter.
This chapter requires that all plans for the subdivision or development of land lying within Sellersville Borough be submitted for approval to the Borough in accordance with procedures set forth herein.
A. 
Approval by the Borough Council. The Borough Council shall be vested with the authority to approve or disapprove all major subdivision and major land development plans.
B. 
Review/approval by the Planning Commission. The Planning Commission shall be vested with the responsibility of reviewing all major subdivision and major land development plans and submitting a written report to the Borough Council thereon. Additionally, the Planning Commission shall be vested with the authority to approve or disapprove all minor subdivision and minor land development plans.
