In order to ensure proper drainage and ecological survival of
the sources flowing into Miller's Pond and the Nissequogue River
and in order to preserve the existing wetlands, there shall be no
building, filling or blacktopping on that portion of any property
which contains tidal or nontidal waters, wetlands or marsh areas and
no building or structure shall be erected or altered within 50 feet
of the high-water mark of such tidal or nontidal waters, marshes or
wetlands. For the purposes of this section a "marsh" and "wetland"
shall be defined as, but not limited to, that land within 75 feet
of the edge of any watercourse.
